Would like to know how often the schools contacted parents saying, ‘hey, wanted to let you know that your kid, John is asking to be called Joanne and is wearing a dress” or hey wanted to let you know your daughter is a lesbian”.

I think Newsom just did the People of United State of America a GIANT favor. He showed who he really is.

Newsom political aspirations of holding a nation office or being POTUS just evaporated when he signed this legislation into law. By signing this bill he is telling anyone who will listen that Parental rights do not exist in California AND neither does the 1st Amendment of the United States Constitution.

This law just violated every Teacher’s Constitution Right of Free Speech by compelling them to remain silent or be punished. The United States Supreme Court has already decided in West Virginia State Board of Education v. Barnette, 319 U.S. 624 that compelled speech is not Free Speech. If a child cannot be forced to salute the flag or recite the Pledge of Allegiance then how can a Teacher be required to remain silent about the mental heal of a student?

This law have a “Chilling Effect” on Teachers coming forward with other concerns by discouraging or deterring influence that prevents them from expressing themselves due to fear of breaking a law or regulation.

Newsom may think California is a “Nation-State” and he has unlimited power but he does not. California is still just one of 50 states and thus is subject to federal law, including the U.S. Constitution.

California politicians sometimes ignore that basic fact of civic life in their zeal to lead the parade. But when they cross the legal line, as defined in federal law, they get their comeuppance.

This is going to be another example of a well deserved comeuppance. This law will not pass Constitutional muster of either the California or United States Constitution. It is a blatant attempt at suppression of Free Speech and cannot be allowed to stand.

My question is why was this legislation passed? For what reason? Parents are responsible for their children until they’re 18. It’s a parent’s right to know this information. I see, so you all are in favor of having the school out your kid. Schools have been doing it. States like Idaho and North Dakota are legally forcing the outing of transgender kids by school officials. Shouldn’t they just be focused on teaching rather than policing gender identities of children? Shouldn’t the discussion of gender identity be solely between the child and the parents? And what if the child fears the parent and the sentiment at home? What if the parent is like “no kid of mine is going dress like that”, and yet you all think it’s acceptable for the school to out the kid to their possibly volatile parent and possibly set that kid up to be further traumatized? You want to talk about teen suicides, forcing the outing of trans kids only makes matters worse.

States like Texas and Alabama already bar parents from providing their trans children with medical care and therapy. How much worse can we treat a child who is struggling with their gender identity? It’s like trans kids are criminals. And forcing the school system to out a child is like saying that the child is doing something wrong or exhibiting bad behavior that needs to be punished or corrected. Would you be okay with school officials calling to report that your kid has been spreading the word of the Bible? And you happen to be an atheist? Wouldn’t you feel like telling the school to mind their own beeswax and get back to teaching instead of policing your kid’s religious identity? Same deal here. These kids don’t need to be outed. They need to be loved and accepted. I’m not a big fan of Newsom either, but I am a big fan of protecting kids whenever possible, and this bill absolutely does that. I know this post will only get thumbs down, but so be it.

I don’t understand your argument. First, your imagery of teachers in “formative years” is much different than what I might concur up. I grew up in a ghetto with bussing, racial tensions, and poverty. My teachers in the 60s were horrible. They abused students both verbally and sexually, openly discriminated against minorities, they paddled students, humiliated them. Why would I want that for my own kid? Kudos to you for finding your lifelong friend and advisor in a former teacher. I didn’t have that experience. I also don’t get the “final choice” scenario you present. Whether a child depends or doesn’t depend on their parent is up to the child, not some teacher at school.

Plain and simple, this bill protects kids from being outed by the school. It prevents school administrators from intervening in what is really a family matter. It’s the family’s decision, not the school’s, to decide when or how such a serious discussion would take place. Equality California, an LGBTQ+ civil rights organization, states that “LGBTQ+ youth across California can now have these important family conversations when they are ready and in ways that strengthen the relationship between parent and child, not as a result of extremist politicians intruding into the parent-child relationship.” It also explicitly protects school employees from retaliation who wish to provide support to LGBTQ+ student’s in their right to privacy.

More and more we see our schools being overtaken by policies not formed by educators, but rather politicians and special interests: books that are getting banned in school, history that is restricted from being taught, making the Bible a part of the required curriculum in public schools and firing employees who refuse to teach it. And here in California they want to out trans kids for no reason other than to meddle in private family matters. You can bet the religious right has a lot to do with that. So what comes next, banning trans kids from participating in graduation ceremonies, proms, and other school events? I mean, that already happens, right? What if they start banning trans kids from even attending school? That’s where we’re headed if we don’t put measures like this bill in place to protect LGBTQ+ students privacy.

In you arguement you state that that ‘in California they want to out Trans Kids for no reason than to meddle in private family matters’. But isnt hiding the child’s feelings/beliefs from the parent, meddling in private family matters? Maybe it is a no-win situation, but this law is allowing a teacher to hide a child’s behavior from a parent. That is one of my biggests issues with this law.
I couldn’t care any less about any LGBTQ+ beliefs – believe what you want, UNLESS it impacts a child or other vulnerable population. This law is going after a child.
You re right, trans kids have been banned from a prom in the United States – wrongly so. I do believe they should not be allowed in sports. But these bannings are not common in the United States and they have been challenged and the offending schools/administration punished. But do you really think that this law will change that? It will not! The school will still know that the kid is trans, so it changes nothing.
You also state that the ‘more and more we see our schools being overtaken by policiies not formed by educators but rather policians’ … Isn’t that EXACTLY what Newscum just did? So is it now two wrongs make a right?

That’s the problem. Once a certain special interest group, like the religious right, starts to meddle into school policies (outing trans kids), then the opposing interest group, liberals and civil rights groups, have to counter that by stepping in with a law to stop the discrimination. These days, schools have become the battle grounds for special interest. I would wager that every law the liberals have come up with pertaining to our education system are but responses to what the religious right had initially started. Newsom would not have created this law if the religious right had not made it an issue to begin with. A protection law is created when someone’s rights are being infringed upon. It’s not the other way around. They don’t put a protection law into place and then wait for someone to trip the wire. The law is there as a response because trans rights were ALREADY being violated.

You say that the law hides a kid’s behavior from their parent. First of all, do you see that kid’s behavior as being wrong? The statement “hiding a behavior from a parent” implies that the behavior itself is bad, wrong, and unacceptable. I can see if the kid is bullying someone, or they brought contraband to school, or they’re vaping in the bathroom, or they’re stealing personal items from lockers… these are all bad behaviors. Further, these are inexcusable actions that impact other students around them as well. And it would definitely be wrong to hide these behaviors from the parents. They should be notified immediately so that the behavior can be corrected or punished by the parent and/or school, as in suspension or being grounded or whatever. But is being trans wrong? Is that what you’re saying? Is it so wrong that the school has to step in and notify you that your kid is exhibiting trans behavior?

Look, if a kid is hiding their being trans from their parents, then there is definitely something wrong in the home situation. The school ain’t gonna fix that. They can’t counsel or arbitrate between family members and offer a solution, they can’t offer health advice, they can’t do squat other than to point a finger and say you’re child is trans. To which I would say, yeah, so what’s it to you? Stop the outing. Let the kid and the parents have that conversation when – and only when – they are ready to. And that conversation may never happen. And maybe that’s the way it should be, especially in a volatile home situation, in which case the trans kid will grow up and choose whatever life they want. But this is not something for the school to stick their nose into.

Do your children’s current teachers currently tell you everything about your kid’s life at school?
Do you expect teachers to keep you up to date with all the new slang?
You do understand that being a mandated reporter means that the teacher doesn’t report to the parents when they see signs of abuse, they report to authorities. Because statistically, it’s the parents causing the abuse. They do have the most opportunity.

Most of all, why is it the school’s job to make sure there are no communication gaps between you and your kids? That is a parent’s job. For all the grief we give the school’s on this site, you now trust them to know your children better than you do?

3) kids are excluded for anything and everything today and have been always by their peer groups. So where are the protections for our goth, fat, nerds, etc …. They are all made fun of, excluded, etc.
4) a child, as defined as 17 and younger, cannot legally enter into a contract, needs a permission slip, etc, why are granting them the right to be called something other than their given name without parental permission/awareness? Who made Dictator Newscum the authority over my children?

The problem is parents are not close enough to their children to know their sexual identity. Parents need to spend more time with their children, and support them, and not be afraid to discipline them.

I also think that someday research will show that gender identity is caused by metabolic imbalance. Hormones go out of balance and the person starts to believe they are supposed to be that gender. Bring hormones back in balance and they’ll probably think different.

No wonder California public schools are losing enrollment while private schools are flourishing. Parents no longer trust public schools because public schools no longer trust them.

What’s insane is that you’re accusing teachers of being child abusers. By the way, private school enrollment rates are highest among upper-income families. According to the Pew Research Center, private school enrollment rates are always what they have been. They are NOT proliferating, as you erroneously stated. Parents are not taking their kids out of public and putting them into private. Do you know how much a private school cost? The tuition at De La Salle High in Concord is $23,800 a year. You got that kind of money? Too many factors go into why public school enrollment is down. Many students continued at home for online education after the pandemic. Some families resumed schooling through charter schools. According the Public Policy Institute of California, ‘the long-term trend of falling enrollment primarily reflects declining birth rates and net migration to other states.’ There you have it. None of this has anything to do with parents “not trusting public schools because public schools don’t trust them.” What the heck does that even mean?

Chico, Mike is not implying that ALL teachers are child abusers. As he clearly stated in his post, that those who are “child abusers in positions of authority will tell kids to keep “their secret” quiet and warn them not to tell their parents”. That’s where the disconnect happens and “opens the door” to those inclined to sadly take advantage of such a situation.

Probably many here who used to vote for “Democrats” which is different from “dems”. The latter is a silly, delusional and ideological bunch who vote “dem” to be part of that crowd because they think it is “chic”. It’s the fall of what once was the Democratic Party. In what crazy world should this dangerous law be acceptable!? When did parents begin to get the “back seat” when it comes to their children!? There is never any information a school district should withhold from a child’s parents.

Laws like this continue to build on the premise that the State is not only more important than parents, but smarter and claims to know what is best for a child. Plus, building on this precedent, what future laws can we imagine will be next? It’s frightening to even consider. Big Brother is becoming the dominant force in California. Be warned!

Following Elon Musk and his companies will be many more families and businesses leaving the once-great State of California.

If this subject of “keeping secrets” from parents applies to the most intimate, nuanced, and personal topic of sexuality, where will it end?

For another example, what if a child came to a teacher and confided in him that she was drawn to shoplifting? Should the teacher be compelled to share this news with her parents – or should he have the option to keep this a secret if he wanted to? What about other topics: anorexia, depression, thoughts of suicide?

Is it the teacher/school administrator the one who gets to decide how to handle the child’s concerns, challenges, and struggles? And how – and by whom – is it determined if the child lives in a “loving home” or some other perceived family environment?

Laws like this open the door to the State raising our children. Schools used to simply teach reading, writing, and arithmetic, but have morphed into thinking they need to take a greater role in social issues. (Some might even go so far as to think the State is indoctrinating students.) Next will come laws about whether parents can spank their children or put them in a time out or allow the usage of smartphones or give them sugary caffeinated sodas to drink. Parents have been making what some would consider “bad decisions” since the beginning of time, but like it or not they are the parents and they have that responsibility and power to do what they think is best for their kids.
