Contra Costa Health Dept. Urging Employers To Consider Requiring COVID-19 Vaccine For Employees

The health departments in Contra Costa, Santa Clara, and San Francisco counties are urging all employers to consider implementing workplace COVID-19 safety policies that require their workforce to get fully vaccinated as soon as possible.

For any employees who are not yet fully vaccinated, employers must require and enforce masking under current state law, according to the Contra Costa County Health Department. In addition, employers are encouraged to require frequent COVID-19 testing of unvaccinated employees.

“Workers who are unvaccinated against COVID-19 pose a substantial health and financial risk to the workplace,” said Dr. Chris Farnitano, Contra Costa County’s health officer. “Most importantly, workplace exposures have led to serious illnesses and deaths.”

Requiring documentation of COVID-19 vaccination rather than self-attestation is recommended as a best practice for employers to ensure workers are adhering to the appropriate workplace protections, the health departments said.

Current state and federal employment law support employers requiring documentation of vaccination status, requiring vaccination as a condition of employment, and requiring additional safety precautions including masking and frequent testing for employees who are unvaccinated.

Yes. Imagine the feedback as to why not. “I work all day” “I don’t have time” I get home too late to go to get my shot” on and on. These are hardworking individuals, yes. But excuses don’t cut it. So, let’s bring it to the employee, is the way to view it and present it, required not forced.

I never ever in my life got the flu shot, my reasoning? I never had the flu in my life, why would I need the shot. When COVID hit, had no hesitation about getting my shots whatsoever.

Sorry, the vaccine still remains a mystery of what effects it has on our bodies and the long term effects, Hand washing and masking ans distancing is the safest way to go.

But it’s a private company and they can choose whether or not you can work in their space.
If it is OK for businesses and companies to refuse service to others depending on their religious beliefs or sexual orientation, then it is Ok for the private companies to install their own safety regulations.
Or you could just go and get the shot and keep everyone safe

Bud E – thats a bad faith argument.

Yes, its a private business…but this is (practically speaking) a government mandate that has an intermediary step. At some point, the government makes it harder for a business if they don’t toe the line. That could be additional fees, revoking of a business license…and this is all bureacractic directives…the public didn’t have a say in it at all.

I would guess many CA employers have had just about enough of California’s regulatory culture. Heart disease is a big killer. Why don’t they focus on diet while they are at it? If we are going to require vaccination, we should also shut down all fast food restaurants and require documentation of daily exercise.

Bud, flu is contagious. Do you support mandating that everyone get the yearly flu vaccine whether they want to or not? Tens of thousands die every year from the flu, if it saves one life…

Two things can both be true. Getting the vaccine is a good idea for most people and will aid the community as a whole. And secondly, the government asserting the power (through facist corporate/government fusion) to force medical procedures is evil. We used to understand the sanctity of the individual and their conscience in this culture.

By the way, everyone that wants government run healthcare. Guess what they will be able to do once they are in direct control of your medical decisions?

I honestly don’t recognize this country anymore. People will vote for totalitarianism if it makes them feel safe. And the punchline is you are never any safer, just less free.

Well, they used Farantino as the spokesperson, so that was a fail from the start. But now our county is suggesting that business FORCE employees to take a vaccine that is only EUA. It should be interesting to some that only Pfizer has applied for full FDA approval at this point ..

I get it, some folks think this is a public health emergency. Some. But if you are vaccinated, why do you care what the unvaccinated person does? This is so stupid!

Good to know Pfizer applied for full approval. Since many don’t know. EA stands for Emergency Authorization, and all the documentation says these are human trials for the vaccine

Yes, but the vaccine requirement should be limited to industry. For example, all Heath care workers should be required. As matter of fact, in tx, a court already ruled against nurses who didn’t want to be vaccinated.

At this moment in time is there an overabundance of labor available or is there an underabundance of labor available?

Seems to me that employers are having a very hard time finding people willing to be employees. Will adding further restrictions upon current employees cause some to leave and will those added restrictions cause potential employees to look else where for jobs?

I guess time will tell.

EUA products are unapproved, unlicensed, and experimental. Under the Nuremberg Code—the foundaton of ethical medicine—no one may be coerced to partcipate in a medical experiment. The individual’s consent is absolutely essental. No court has ever upheld a mandate for an EUA vaccine. In Doe #1 v. Rumsfeld, 297 F. Supp. 2d 119 (2003)15, a federal court held that the U.S. military could not mandate EUA vaccines for soldiers: “…[T]he United States cannot demand that members of the armed forces also serve as guinea pigs for experimental drugs” (Id. at 135).

You may wish to check the case involving Houston Methodist Hospital. The hospital required its employees to be vaccinated or either resign or be fired. Over 150 workers chose took one or the other route out the door and no longer work there. Earlier, a federal judge dismissed a lawsuit filed by employees claiming their employer could not require them to be vaccinated.

“The hospital’s employees are not participants in a human trial,” Judge Hughes wrote. “Methodist is trying to do their business of saving lives without giving them the Covid-19 virus. It is a choice made to keep staff, patients and their families safer.”

Some of those personnel refusing the EUA injection at Methodist Hospital were on the front lines during the height of the pandemic and caught COVID 19. Their body’s acquired natural immunity to COVID 19 is infinitely superior to the EUA injection. Why should they be forced? Why all of the sudden are we not following the science?

The case is being appealed, rightly so. Judge Hughes decision will not stand, he’s way out on limb and he knows it!

Understand that the government “urging” employers to require vaccines is because they (the government) cannot LEGALLY DO THIS. My businesses will never require vaccines and my goal is to offer job opportunities in many different industries so people will have a safe haven to work – free of spineless businesses and corporations who require their employees to make personal compromises just to earn money. There are different issues here. First of all a private business has the right to do what they deem best for their business and safe for their employees. If you come into work coughing, sneezing with a high fever, your employee can ask you to go home. He can do it out of compassion for the person who is ill, he can also do it because be fear that a sick employee might make other employee’s ill, thus putting his business in jeopardy . An private business has the right to determine what is best for his business and his employees. If he is worried about an employee infecting others, he can take appropriate action However, if he terminated an employee because said employee won’t get vaccinated, employee can probably get either unemployment or workmans comp, not sure. I see lawsuit from different groups coming.

Sure, employers shouldn’t require employees to disclose their vaccination status. They should be required however to disclose that to the public, so potential customers can make informed decisions on where they do business. Have a sign in the window.. no masks required and we don’t ask, simple as that.
