A 30-year-old Martinez man has been formally charged with two felonies in connection with allegedly waving a loaded firearm during a July 5 argument with defenders of the city’s Black Lives Matter street mural on Court St. in Martinez, Contra Costa County prosecutors said Thursday.
Joseph Osuna faces charges of unlawful firearm activity and carrying a loaded firearm owned by someone else, both felonies, and with exhibiting a concealed weapon in public, a misdemeanor, according to the District Attorney’s Office.
At about 6 p.m. on July 5, witnesses told police that Osuna yelled, “All lives matter” as he drove past the Black Lives Matter mural painted the previous day in front of a Martinez courthouse.
Police said Osuna got into an argument with one of the mural’s defenders, then did a U-turn in his 2015 Jeep, got out and pointed a loaded .22-caliber revolver at that person.
Police were already nearby, and quickly stopped Osuna’s Jeep.
Officers recovered the loaded revolver, which is not registered to Osuna, in the vehicle, and arrested him.
Osuna faces up to three years in jail if found guilty of all charges.

Agreed. I’m very pro gun, but this guy was clearly breaking several laws in his use. Even if he had somehow been the legal owner, and licensed carrier, you never ever draw and brandish a gun unless you are confronting a lethal threat. Political disagreements and road rage don’t count as lethal threats.
This is also why the St Louis couple were borderline. I don’t think they should be legally ruined over it, but they very much needed training, and should have done no more than stand quietly with weapons pointed in a safe direction until such time as an immanent threat presented itself. I think their going on TV and repeatedly claiming they feared for their lives and property is their way of laying the groundwork to defend themselves on court. They are lawyers, after all.
Confiscating his legal firearm and letting the mob know he is defenseless isn’t right either, though.
Brandishing a weapon is the last thing you should ever do unless your life is in jeopardy. That said every American should be legally open carrying or concealed carrying. It’s not called the peacekeeper for nothing

I can see how with all of the sickness, insurrection, turmoil, and hypocrisy going around today that someone who is sick of it loses control. It is not easy watching your country being torn apart by idiots and having city and state governments going along with it.
The guy was driving around with a loaded gun that wasn’t his. He was looking for someone to trigger him. Is it okay for Black people who are, as you say, “sick of it” to lose control?

I’d love to see video of this incident, often times these are people producing a weapon in response to a large crowd starting to surround them while making threats. But, liberal judges in liberal courts with liberal politicians all scared of a openly violent, Marxist liberal mob means these people get thrown to the wolves.
