@Misplaced Texan, it’s not just a California thing. President Trump announced on Wednesday that the federal government will move to ban flavored e-cigs.
It seems those dying or getting sick are using a weed oil, an off the market thing. Not flavored products. To an old guy like me all of these tech things are moving too fast. First graders with telephones, playing video games all day, marijuana sales, overdoses on imported drugs, ban this don’t ban that, people protesting everything. It appears many are in a rat cycle. I don’t see it getting better soon.
No, because most of the people who have recently contracted illnesses or even died were due to bootleg cartridges, and most of those were THC…so if you go an ban the “fruity” and other flavors, guess what you’ve just created? Yep, a black market susceptible to these same bootleg pens/cartridges…or you’ll push people to good ol’ regular tobacco cigarettes. Obviously, NO amount of smoking of ANY kind is good for you, and I honestly don’t know how someone can do it and when I see a huge vape cloud blowing out a car window I just think of how stupid that person is…BUT, if people are going to do it, they’re better off with the heavily regulated JUUL and the like rather than the bootleg stuff or combustible tobacco.
Juul is one of the main problems with the vape industry. They are the reason so many minors are vaping and give the vape industry a bad name. I mean come on they sold a large chunk of their company to big tobacco just so they can get into more liquor stores and gas stations. Especially the ones where they sadly don’t check your id.
The United States is a free country. Big bad government trying to tax or ban anything and everything. If I want to vape while drinking a Pepsi using a plastic straw, as a free American, I should be able to.
I agree with you in general, but I want to make a point that if you make bad health choices all your life, you will become a burden on the healthcare system. Even if I make healthy choices and require much less care in my life, I am punished because my insurance premiums and Medicare taxes are subsidizing those who are sicker than they would be had they lived a healthier lifestyle.
Unfortunately, Bob, that’s how insurance works. Just like auto insurance. Those of us who are safe drivers must subsidize (at least to some degree) those who are not. Should we charge people more for health insurance because they’re athletic? Sports cause lots of injuries, right? Maybe charge people more if they ride a motorcycle, climb mountains, or anything else deemed dangerous. Nope, not gonna happen.
Chicken Little, there are health insurance policies that exclude coverage for dangerous recreational activities such as bungee jumping and rock climbing.

Chicken Little, here’s an example of a health insurance policy that excludes dangerous activities. It’s the policy offered to students at Wesleyan University. Here’s the exclusion:
“27. Racing or speed contests, skin diving or sky diving, mountaineering (where ropes or guides are customarily used), ultra-light aircraft,
parasailing, sail planing, hang gliding, bungee jumping, travel in or on ATV’s (all terrain or similar type vehicles) or other hazardous sport or
hobby.”
From the quick check that I’ve done, it’s legal under fed rules to include “source of injury” restrictions in health insurance as long as the injuries aren’t the result of domestic violence or a medical condition. Perhaps CA law is different?

The purpose of a firearm is to direct a projectile at a target with a great deal of velocity and accuracy. The purpose of a car is to transport people or goods to or from a destination (target). The target in both cases is at the sole discretion of the operator.
He said guns are made to kill, not to commit crimes. And he’s right. Functionally speaking. Unless you shoot free pistol competitively or are a bi-athelete. You could argue those are target purpose specific, though based on a design of a weapon used to kill something. Yeah, he’s right.

Please explain what the framers meant with the phrase “subject to the jurisdiction thereof” in that amendment. Hint: you’ll need to dig deeper than just reading the Constitution. Take a look at Elk v. Wilkins and the Wong Kim Ark Supreme Court rulings.
@Rollo Tomasi, it means the children of foreign diplomats aren’t US citizens. This is not something that divides liberal and conservative jurists. There is near universal agreement on what the 14th amendment means. If you are born on US soil, you are an American citizen except for a very narrow exclusion.

Freedom is great until doing something stupid like voluntarily inhal9ing chemicals into your lungs is done and then my health insurance rates go up as providers have to start paying out money to keep these people from potentially dying.
It is a personal choice for adults. Children and underage do not have developed brains to make adult decisions, so for them of course NOT.

Banning them will have the opposite desired outcome. People are still going to buy vapes and those vapes are going to be untested, unregulated product. If the ban is for safety concerns, that’s the wrong way to go about it.

Contra Costa County Board of Supervisors, banned all flavored tobacco and e-cigs in unincorporated areas of the county years ago.
Any store within a 1000 feet of a school, park or other places kids get together.
They also banned any store in unincorporated areas that have a pharmacy on the premises can no longer sell cigarettes or other tobacco products.
As for the current issue it relates to unground making of marijuana vaping Cartridges made with Vitamin E oil, it turns to Vitamin E acetate which is harmful and causes the lung damage that is being seen now.
YES! E-cigarettes should just be for those trying to stop smoking. Not taste good for those who haven’t started. No Flavors!
E-cigs/vapes have ALLEGEDLY killed a small handful of people, and there is public outcry for their prohibition. Yet tobacco companies kill 1000+ of their own satisfied customers EVERY DAY, and they’re able to weasel out of it.
How are we even sure if vaping is the issue at this point? And how are we sure that these deaths and illnesses aren’t just linked to a single brand or type of product? We can’t keep making laws based on emotion. We need to study these things and make rational decisions.

Who would argue that using tobacco isn’t extremely stupid?
Can some tobacco users be trusted to make sound decisions, or are they weak-minded addicts unable to exercise self control?
Are people making stupid decisions a negative force on society?
Considering the enormous added cost to healthcare that we ALL must pay, would we be better off without them driving up our premiums?
Should tobacco users with diseases directly related to it’s use be required to pay 100% of their healthcare?
Should they be required to pay into a separate insurance fund for tobacco users, similar to assigned risk auto insurance policies?
Should they be permitted to make their mindless choices and left alone to self destruct?
Should the rest of us have to carry the burden for their ignorant choices?
