City Of Concord Now Accepting Rent Adjustment Petitions

The City of Concord is now accepting rent adjustment petitions. Petitions will be heard before a Hearing Officer during a rent adjustment hearing as part of Concord’s greater Residential Tenant Protection Program that went into effect earlier this year. If you are a residential property owner requesting an upward adjustment in rent due to a fair return on investment claim, or you are a residential tenant requesting a downward adjustment in rent due to receiving a rent increase that is not in compliance with the Ordinance, you can now submit a petition for a rent adjustment. No level of government should ever be involved in the contractual agreements between a business and its customers.

what’s that…? You filed a rent petition with the city’s new rent program for a rent adjustment hearing where some enelected bureaucratic clown will decide if your rent is too high?

Ok, got it. Since you’re on a month to month tenancy, and have been for many years now, plan on vacating in 30 days. I’m putting this property up for sale, and damage beyond normal wear and tear will be billed to you, or a lawsuit will be filed against you for damages. I propose you start looking for another place to live right away, and probably not a great idea for you to put me down as a reference, as I will honestly tell a future landlord the factors that went in to my decision to terminate your occupancy and sell. It’s tough out there, good luck to you.

Whatever, the new Concord rental control ordinance has “just cause” restrictions which actually prevent you from evicting your tenant so long as the tenant continues to pay rent and does not break the law. Month to month tenancy is a thing of the past. Your documented lease term, even if signed by the tenant, means nothing. No such thing as a short term rental. The tenant can leave at the end of the lease, but they don’t have to.

Want to sell your house? You can’t evict the tenant. You are obliged to sell the home with the tenant in it if they decide to stay. The new owner may evict them under the owner move in rules, but they would have to pay the tenant moving expenses plus 2 months rent if I recall.

if you own a single family home in Concord, these are just some of the rules you have to abide by. You can thank Councilmembers Edi Z Birsan, Laura Nakamura, and Dominic Aliano for imposing the most severe rent control ordinance in the state.

BTW, there is one candidate running against Edi who is opposing this rental control fiasco.

I used to work with my tenants by asking them what they felt a fair increase was. Most replied with something reasonable. Some said nothing and I sometimes did not increase until the following year if they were good tenants. I think that I am just going to do the maximum allowed now. Don’t know how else I will capture the increased property taxes, including bond assessments, and insurance costs. Sad.

OK, got it. This is your 30 day notice to vacate, as you have been on a month to month tenancy now for many years. I will be selling the property, so you will need to find another place to live. Any damage beyond normal wear and tear will be billed to you, or a lawsuit filed for relief. I would also recommend you not use me as a landlord reference as you apply for a new rental, as I will communicate to them all my legally permitted interactions with you as a tenant. Good luck, it’s tough out there.

I own 2 homes in Concord that will sit empty. I will never rent. To much goverment in our business.

Everything these guys do is unbelievably shortsighted.
Investment property owners simply 1031 their California property into at least two properties in states such as the Carolinas, pay property managers to handle the details, and likely have cash left over. These transactions have been going on for a while and our elected officials attitudes are likely good riddance as they want the increased property tax revenue.
However, the California properties sell and become owner occupied, because real estate investors want nothing to do with California anymore. Therefore rental inventory goes down, which I believe is counter to politicians screaming for more affordable housing. And guess what? Demand sets rental prices, and less inventory means higher prices.
Shortsighted, uneducated, or they simply want to generate sales for increased property tax revenue.

So when there’s no more landlords, what then?
And ‘landlord’ needs a new name.
‘Housing provider’. Much better. 🎯

Rent control is un-American. Period.

Do “they” go into Macy’s and tell them how much to charge you for a suit? NO.
Do “they” go into Safeway and tell them the maximum they can charge you for Beef or Bread? NO.

Too bad “they” lied to you when you were growing up.
Whiners! ~~~everyone does not get a trophy just for showing up.

Every landlord in Concord should file the petition stating the increase in water, gas, electric, garbage pickup, landscaper and insurance. They should lay out cost increase of each and say they want to pass them on to the renter each year.
