California Lawmaker’s Bill To Decriminalize Plant-Based Psychedelics Passes Final Legislative Hurdle

A California lawmaker’s bill to decriminalize plant-based psychedelics including “magic mushrooms” has passed its final legislative hurdle. Now it’s up to Governor Gavin Newsom.

The Senate approved Senator Scott Wiener’s Senate Bill 58 on Thursday. Newsom hasn’t indicated whether he will sign the bill into law.

The proposal would remove criminal penalties for personal possession and use of psilocybin and psilocyn found in psychedelic mushrooms; dimethyltryptamine or DMT, used in the hallucinogenic tea ayahuasca, and mescaline, but not peyote.

The bill would also set in motion an administrative process aimed at allowing psychedelics in therapeutic use.

“Veterans and anyone suffering from PTSD and depression should not face criminal penalties for seeking relief,” Wiener said in a statement. “Plant-based psychedelics are non-addictive and show tremendous promise at treating some of the most intractable drivers of our nation’s mental health crisis.”

A 2021 effort by Wiener to legalize psychedelics passed the Senate but failed to advance in the Assembly.

So let me get this straight, with the explosion of open air drug use all over California, as reported on news, any person with eyes can see it in their communities. Now our legislature want legalize more drugs? Who votes for these idiots?

More ill-conceived legislation brought to you by State Senator Scott Wiener (Democrat-SF)!

Wiener is a menace to everyday common sense and exemplifies why CA is a social toilet.

Why? Because corporations are getting in on the action. Put it is a pill, sell an IPO and make a billion.

Just what local law enforcement wants to deal with. I’ve been kicked out of some very nice places high on psychedelics. It’s not a drug that should be legal.

Drug use is already out of hand. Why bother having any laws about drug use if California is expanding what is in theory suppose to be legal?

If you know your stuff … which I do … these magical plants are wonderful medicine … studies on prisoners show a SIGNIFICANT reduction in recidivism … the world needs this natural medicine … while potential for abuse is true for everything in life … the good far outweighs the bad … especially in treating depression and PTSD … and don’t knock it till ya try it … #microdose

Yeah, but look what legalization did to the strength and availability of weed. Now imagine that with psychedelics.

Jojo The Circus Clown September 12, 2023 - 12:12 AM - 12:12 AM

It’s not an issue with the medicine … it’s the lack of leadership in common sense regulation & rollout … just take the Oxycodone fiasco as an example of leadership misconduct … I understand the arguments, but they just fall on deaf ears for those who know the data and results of this therapy … try a microdose … see for yourself … life changing … really … and I am not nor have never been a fan of criminalizing addiction … it’s a public health issue

yoyohop September 12, 2023 - 9:12 AM - 9:12 AM

Agree… It’s about the lack of leadership.

In societies with a tradition of psychedelic use, the substances were usually regulated by a priest or shaman. They were seldom taken and then under supervision and often ceremonially.

But today’s trend is to make them commercially available, to take them often and casually, with the belief that this will have a positive effect on your well-being.

Many will take them with weed or other substances and emerge from the experience more mush-brained than ever – but somehow believing that they’ve just taken medicine.

I’m not saying the solution is criminalization. But people have to admit the truth – These things are drugs. Their widespread and wanton use will be at the detriment of society.

Issue drivers licenses to those without proper paperwork, pot, now ‘shrooms & such .. what’s next? oh yeah – safe injection sites at our expense again …. I didn’t vote for them….

Microdosing small amounts of mushrooms is very popular now. I know teachers, parents, tech execs that will take a small amount of mushrooms to party instead of drinking. It’s actually healthier on your body and gets you less messed up. Magic mushrooms have been proven to make people more empathetic in scientific testing. Prob could use more of that in this world especially on the right. Just sayin

yoyohop September 11, 2023 - 8:35 PM - 8:35 PM

Micro-dosing is nothing new. Hunter Thompson and Ken Kesey were talking about it in the 60s. It didn’t solve anyone’s problems – especially when taken as a party drug. Its just mental fireworks.

As far as scientific testing – LSD was scientifically tested by the government too – as a drug conducive to mind control. Much of the acid from that era was government funded. Many who regularly partook had nervous breakdowns and permanent impairments.

Are we really going to fall for the whole conscious expanding fallacy again?

People are always searching for the next quick fix to a problem or disorder. Read Michael Pollan’s ‘How to Change Your Mind’ for some insight on this topic. The State of Oregon has suffered immensely since legalizing shrooms. Just ask medical personnel, teachers, parents, and law-enforcement how this is working out in the state north of us. I’m open minded, but don’t need psychedelics to open it for me.

Jim September 12, 2023 - 8:25 AM - 8:25 AM

Clinicians started looking at psychedelics as alternative treatments due to desperation in the current mental health crisis. Psilocybin was granted breakthrough status in treating major depression because it was shown to be so effective. MDMA was granted breakthrough status in treating PTSD because it was shown to be so effective (and we knew this back in the 80’s but couldn’t study it due to MDMA being made illegal!).

You can hate drugs all you want but the facts don’t lie – these substances are saving lives. There hasn’t been a new treatment option for PTSD in over 20 years and the current SSRI barely works. MDMA is on track to be the standard of care for PTSD in a few years and this will improve the lives for many people (especially veterans) for years to come. We’re just getting started here too – there’s a boatload more substances and applications to research.

Take it from one that ate mushrooms many many times in the 80’s,it should not be legal.Next, they will legalize LSD,it’s basically the same effect, and danger.

Shrooms for the people! If they make us feel better they should give them to us for free. They might be good at treating school children? Maybe I can get a contract to distribute them to schools, it could make them feel better you know ’cause school can be hard for kids. If your against my idea then your against kids feeling good to be at school!!!

Is there a worse legislator anywhere than Scott Weiner? Inquiring minds want to know. There’s some stiff competition (Ted Lieu, Nancy Pelosi, Maxine Waters?) but the man works hard to be as bad as possible.
