California Attorney General Supports Effort To Hold Gun Industry Accountable For Violence

California Attorney General Rob Bonta drew his support for a multi-state effort to hold the gun industry accountable in times of gun violence.

Bonta joined 17 other state attorneys generals in filing an amicus brief on Monday that supports New Jersey’s defense against a legal challenge to its firearm public nuisance statute in the U.S. Court of Appeals for the Second Circuit.

The New Jersey statue grants victims the right to pursue legal action against members in the firearm industry if they violate state law. The brief argues that New Jersey’s policy is in line with states’ rights to make laws that protect consumers from harm and encourages responsible business practices.

The statute mirrors California’s 2022 Assembly Bill 1594 — a policy sponsored by Bonta that allows Californians that were victims of gun violence to file civil suits against gun manufacturers and sellers if they fail to ensure their products are being used safely.

In National Shooting Sports Foundation v. James, a group of gun industry members filed suit to block New Jersey’s statute, though their preliminary injunction motion was denied by a district court. The plaintiffs are now seeking an appeal in the U.S. Court of Appeals for the Second Circuit.

Bonta said the gun industry should not be the only industry getting a “free pass” from being held accountable for the harm its produce cause.

He has also backed other gun violence prevention efforts,-like filing support for states’ right to regulate guns on public transportation, or urging the court to prohibit people carrying guns in places of worship in New York.

“Gun violence has left too many families broken, too many children traumatized, too many loved ones in pain — it’s time to stand up to the companies who sell these deadly weapons,” Bonta said.

Don’t just limit it to the automobiles! How bout Kershaw Knives? Or Dow Chemicals when they make ammonia and mix it with stuff to cause deadly gases? Or HP computers when their computer is used to search for the ‘how-to do whatever harm’ is going on …

Of course they want to hold the gun manufacturers responsible! As long as the standard is equally applied during the bloodshed from guns used in war and LEO activity. But, that wouldn’t make sense now would it?

They only want to do this so people don’t see them for the failed policies that are responsible for the increase in gun violence.

Chuq, Which states are you referring to? Some states require a permit, some don’t, but all fifty states have laws that allow citizens to carry a concealed weapon, and forty-four states have laws protecting the right to keep and bear arms.

Bonta is a looney tunes POS cut from the same cloth as Lieu, Wiener and Pan. They use legislation as advertising regardless of the constitutionality of it. They lean into their tyranny of majority to get things to pass that won’t stand up in the courts. Bonta famously passed the KAREN Act to target white women complaining at school boards about Covid regs. They are all in on finding ways to facilitate getting access to kids despite their parents. Here’s a thought: How about holding those who use a gun in a commission of any crime responsible by incarceration instead of feel good programs, cashless bails, and probation. No, this isn’t a solution, but it’s a necessary step to get a grasp on the problem and keep repeat offenders locked up with less idiots among us.

On the one hand you want to try and blame the gun manufacturers and guns themselves for the violence but on the other hand you let criminals go unpunished and push soft on crime legislation. Maybe it’s time to do something really beneficial for the good people of this State and resign.

Back in the 2000s, under Bush, the Republicans passed a law called something like Lawful Commece in Firearms Act. Even then it was obvious the gun banners were going to use lawfare to try to put gun makers out of business. Government had unlimited tax payments dollars to sue, gun makers do not. So they made it illegal to sue gun makers for the misuse of their products in a crime. You can still sue them if their product is defective, or otherwise causes injury due to their negligence.

Democrats don’t care about laws or the constitution anymore, though. They are so self righteous in their virtue, breaking all the rules to get want they want is actually heroic in their book. This lawlessness is going to unravel the country. If one side unilaterally declares a rule void, there is no reason for the other not to respond in kind. The result is the dismantling of the laws and norms that allow us to function as a country.

All this is very short sighted.

Brazil is 1st. USA is 2nd.
When the population of all countries are factored in, by percentage, the US falls to 32nd.

There was a study done in 2015 that was very revealing comparing gun policies in several nations.
