California Attorney General Bonta Backs Federal Crackdown On Ghost Guns

In the company of attorneys general from 19 states and the District of Columbia, California Attorney General Rob Bonta backed a new federal rule against ghost guns in an amicus brief filed Monday.

The amicus brief, which is an opinion submitted to the court by a party not involved in a case but who carries weight, was supported by Bonta in the wake of mass shootings and the rise of ghost guns, his office said.

Ghost guns are firearms that are privately made without a serial number, making them essentially untraceable for law enforcement. Flying under the radar of state requirements, unlicensed owners and manufacturers forgo background checks and ownership recordings for these illegally produced firearms.

The U.S. Department of Justice said it has seen a tenfold increase in the amount of ghost guns seized by law enforcement since 2016 — last year alone, 20,000 suspected ghost guns were reported to the Bureau of Alcohol, Tobacco, Firearms and Explosives.

In response, the Biden Administration issued a federal rule in April to extend firearm regulations to include homemade guns and easy-assembly gun kits. The rule, which will go into effect next month, will require buyers to pass background checks and for manufacturers to be licensed and produce serialized gun kits.

The rule has since been challenged by a Texas-based gun parts manufacturer, which argues the rule is not legally sound and threatens manufacturers’ ability to stay in business.

The group of attorneys general, along with Bonta, say state regulations need to be backed with meaningful federal oversight.

“There have been more mass shootings in the nation than days in the year in 2022. In California, we know our protective measures work, but we need to see such action nationwide,” Bonta said in a statement.

In California, state law enforcement officers seized 12,388 ghost guns last year, in comparison to 26 in 2015.

Though the California has the 44th lowest gun death rate in the nation, it is no exception to fatal shootings involving ghost guns. A recent example was in March 2022, when a shooter banned from purchasing firearms killed his three children, a chaperone and himself in a church in Sacramento. Or in 2019, when five Sagus High School students were shot, two killed, by their 16-year-old classmate with a gun made by a kit.

“I am in support of stronger federal efforts to curb the gun violence sweeping our country and the killing of thousands of Americans, including children,” Bonta said. “We refuse to accept that gun deaths are somehow normal when we know that there are effective strategies to stop them. My office will continue to use every legal tool available to end this gun violence epidemic and to keep Californians safe.”

It would be nice to see Bonta crack down on the open air drug dealing in many cities around California, but then again maybe it’s a progressive thing to watch Fentanyl destroy so many lives.

Twist is any way you want, “shall not be infringed” is the law of the land.

And for those idiots that think this refers to state militias (ie, National Guard), remember that these are INDIVIDUAL rights.

How many mass shootings have been done with a ghost gun?
I don’t recall any reports of ghost guns in any of the mass shootings, and would think the anti gun nuts would for sure have that all over the head line news if it were to happen. Anybody seen any, anywhere?

and how many of the mass shootings have been one youth group representing a block in the hood against another youth group due to marketing competition for certain “goods,” or, just because of a perceived slight?

Japanese has some of the strictest gun laws in the world. Yet it didn’t stop the assassination of their former prime minister last week.

The assassin used a home-made “ghost-gun” to kill former Japanese prime minister Abe.

@ The Observer Yes, the anti-gun lobby should consider this assassination carefully- an illegal firearm that was almost as slow to shoot and reload as a musket killed one of the highest politicians in the country.

I think the more accurate term for this weapon would be a “zip gun”. The difference being that the gun did not look like it was made from a kit or factory, but rather built with basic parts available at a hardware store.

The assassin fired two shots with the awkward makeshift shotgun. It took about 4 seconds for the second and fatal shot to be fired and still the secret service did not intervene in time to save the prime minister.

What we really need in this state is a retroactive ban on every semi automatic weapon with a removable magazine. That leaves plenty of weapons for target shooting, hunting, and home defense.

I volunteer you to come and get them from me.

Chug – no one, not the State of California nor the Bureau of Alcohol, Tobacco, Firearms and Explosives can tell you how many firearms are in circulation in the US or who has them and it’s got zero to do with ghost guns.

I have lawfully purchased firearms from stores that have no dealer report of sales. Now add private party sales/transfers prior to 1991 when the report of sales of firearms to the State became law.

You would also want to change the 4th Amendment along with the 2nd to allow for general search warrants because the only way to “retroactive” seize these semiautomatic firearms with detachable magazines would be a hard search of every gas station, residence, warehouse, outhouse and doghouse in the State.

You might as well wish for world peace and the cure for Covid since you are in to willful suspension of disbelief.

I remember when SB23 took effect in 2000, Bill Lockyer said something to the effect that if someone doesn’t want to register their AR-15, they should leave the state because they aren’t wanted here. What a douche.
