Gov. Newsom Says State Is Exploring More Aggressive Shelter Order Enforcement

Gov. Gavin Newsom said Monday the state is exploring more aggressive enforcement of its COVID-19 coronavirus shelter-in-place order after residents in coastal areas ignored the order over the weekend by going to the beach.

Newsom led off his daily briefing on the coronavirus by chastising residents in places like Orange and Ventura counties who flocked to local beaches, particularly on Saturday, during a wave of warm weather across the
state.

Newsom argued that the state is weeks, rather than months, away from beginning to loosen shelter-in-place orders due to the coronavirus as long as people abide by physical distancing and other public health practices to avoid spreading the virus. He said that won’t be the case if people continue leaving their homes just because the weather is nice.

“As we change our behavior, we can impact the science, the health and the data,” Newsom said. “This virus doesn’t take the weekends off, this virus doesn’t go home because it’s a beautiful, sunny day around our coasts.”

Newsom said similar images of crowded beaches weren’t as abundant from other areas like Los Angeles, San Diego and San Mateo counties because local governments followed state directives for enforcing stay-at-home orders.

San Mateo County had previously issued an order allowing people to only do recreation activities within 5 miles of their homes. On Linda Mar Beach in Pacifica, that city’s police officers contacted 853 beachgoers and ordered 535 off the beach after learning they lived more than 5 miles away, police said.

State officials are collaborating with the California Highway Patrol, state park patrols and other agencies to enhance enforcement provisions against people who leave their homes for non-essential reasons.

“We will avail ourselves to more aggressive enforcement of the stay-at-home order, of the social distancing, of the guidelines and procedures that we expect to be followed all across the state of California,” Newsom said.

So now you cannot be more than 5 miles from home. And if you are at the beach and live more than 5 miles from there you are in violation of a local Health Nazi Edict. what nonsense is this. Ordered 535 to leave the beach…they did not have that many ticket books. What nonsense. Is Newscum going to activate the national guard to patrol the streets and start arresting people ?

Starting to sound punitive and more and more like house arrest. I would like to know what crime I have committed? I also would like to know how much longer this “state of emergency” can be extended? It has to end at some point. Especially if the so called “second wave” is going to happen regardless. Might as well get it over with. It’s impossible to develop herd immunity if we’re all staying away from each other. It’s also impossible to know if I’m infected or if I’ve had the virus (but no symptoms), if I can’t test because I have no symptoms. And since no one knows if you can get re-infected, meaning you don’t develop immunity, how will we ever get to a point where it is “safe” again to go out? I’m ready to just get out there and live life. If I die because of the virus, so be it. Rather be dead than live like this for the rest of my life!

The whole state should not have to lock down because some people went to the beach

Mongoose, only San Mateo County has the 5 miles from home deal as far as I know and they told people to go home, they didn’t give 535 tickets. Maybe belligerent ones got them, but not if you politely left.
However, this pisses me off. The beaches are for everyone or no one. How the hell did those San Mateo politicians decide on 5 miles? So I live 6 miles and can’t go but ok for you at 5? No freakin way. Close the beaches for everyone, not just those lucky enough to live close.

5 miles oughta be fun to enforce. My local costco is farther than 5 miles from house. San Francisco is more than 5 miles across. 5 miles in San Francisco is way different than 5 miles in Contra Costa County, or say Shasta County …

The reality is that light from the midday sun quickly kills viruses, including the corona virus. Being on a beach around high noon has to be much safer than being in a grocery store picking up the week’s supplies.

I agree. The summer sun kills the virus quickly. In accordance with President Trump’s recommendation, I am also looking at how effective it would be to huff bleach or some other disinfectant to “cleanse” myself.

I think he probably loves these times so he can try and keep people stuck in their homes as long as he can.

I also believe his six-stop program is overly complex and mostly unattainable.

A serious question:

Violation of the stay at home order is a misdemeanor. As the article on Sylvester the car thief proved, no one is staying in county jail anymore and even before COVID-19, mass arrests for civil disobedience were only in custody long enough to be booked and cite released.

Even if the Commissioner of the CHP and all the Sheriffs and Chiefs of Police all agreed to post officers on all the beaches of California there are not enough police officers in the state to both effectively close all the beaches AND conduct normal day to day police business.

So I ask, what other resource is available to the Newsom to more aggressively enforce his order and what will he do with those who engage in civil disobedience?

As I waited outside CVS the other day for a protracted time wearing a mask in public (with a lot of others) I noticed a sign “No Loitering” with some implied threats of enforcement by the Concord Police.

Why are most of the states slowly lifting the shelter-in-place order?
Why can’t we do what are other states are doing?

What Newsom is doing, I think, is total BS. Folks are gonna go bonkers if he continues to be controlling.

Other states are living shelter-in-place to take away emergency benefits. If someone’s place of work is able to reopen, they can’t collect unemployment anymore. If a small business owner who is allowed to reopen decides on their own that it’s not safe, they are on the hook for unemployment for employees. These orders provide protection in two ways — keeping us home and slowing the exponential spread of a virus we don’t understand to give us time to understand it/find treatments/develop a vaccine — and providing a means of relief to businesses through emergency funds and allowing the unemployment burden to be shouldered by the government. It is never going to be perfect and it will never completely unburden the people, but it is actually better than the alternative. The states who are opening too soon will show us what that alternative is and it will be sad to watch. The better thing to push for is more aid than the current stimulus that goes to people and small businesses who actually need it. And shelter-in-place regulation plans that are clear and protective, without inhibiting our lives more than necessary. For example, what if, instead of five miles, they allowed people who live in that county to use an online permit system that could place crowd limits on beaches & parks. People would know before they left their houses that they could spend X number of hours at the beach without crowds that could pose a risk.

If everyone stopped flailing against the idea that we need to keep this unknown virus under control, we could all work for ways to make our lives better while we shelter.

@Passing the Buck – You don’t seriously believe we should SIP until a vaccine is developed? New vaccines normally take years to develop, not months, A month more of SIP will put many businesses out of business permanently. In three months, people will be on the street begging for change. I understand the benefit of SIP to temporary decrease the spread of the virus while hospitals gear-up to deal with it, but SIP was never meant to prevent transmission. The CDC and experts assured us time and time again that SIP is simply to delay the spread, it will not prevent the spread. Increasing Federal aid is not the answer either. We are already saddling our young people with decades of debt. Now this? We need to stop this nonsense and get back to work. The right to provide for oneself and one’s family is a basic human right. Our “leaders” and their cadre of Little Eichmanns will be held accountable.

It’s not a matter of waiting for a vaccine, it’s a matter of gaining a better understanding of what this virus is and how it operates. Did you see the WP article about large blood clots causing strokes in Covid patients in their 30’s and 40’s? This is the kind of information we’re gaining as we go. We don’t even know exactly what we’re dealing with and we don’t have reliable treatments. The news about the remdesivir trial today is hopeful. There are other ways to gain ground before the vaccine. The idea that ending shelter-in-place sooner as if it will save the economy is false hope. It’s going to shift the burdens in ways I don’t think everyone who is advocating for reopening is thinking about. A backslide in cases will be worse for the economy. Forcing a small business owner to choose between opening up when they feel it will put their employees at risk or shouldering the full burden of unemployment isn’t humane and won’t be good for our economy either. Shelter-in-place allows for certain protections that are important. And easing back allows for some margin of error. It isn’t all or nothing, but I’d also like to point out that COVID isn’t either — this isn’t you either survive or you die. What’s not included in our death toll is the people who aren’t ever going to get back to their previous quality of life/health after having this virus. Are you willing to risk that for the people around you? For yourself? If waiting another month would give us a better understanding of this virus, a chance for ramping up production of drugs that are working, and time to explore what measures of social distancing are effective, would that be worth it? Would you rather deal with that discomfort than risk having a stroke? Because that recovery process would certainly keep you out of work longer than a little extra shelter in place.

SUBJECT: Balancing Public Safety with the Preservation of Civil Rights

The current national crisis related to COVID-19 has required the imposition of extraordinary restrictions on all of our daily lives. Millions of Americans across the nation have been ordered to stay in their homes, leaving only for essential and necessary reasons, while countless businesses and other gathering places have been ordered to close their doors indefinitely. These kinds of restrictions have been necessary in order to stop the spread of a deadly disease ­but there is no denying that they have imposed tremendous burdens on the daily lives of all Americans.

In prior Memoranda, I directed our prosecutors to prioritize cases against those seeking to illicitly profit from the pandemic, either by hoarding scarce medical resources to sell them for extortionate prices, or by defrauding people who are already in dire circumstances due to the severe problems the pandemic has caused. We have pursued those efforts vigorously and will continue to do so. Now, I am directing each of our United States Attorneys to also be on the lookout for state and local directives that could be violating the constitutional rights and civil liberties of individual citizens.

As the Department of Justice explained recently in guidance to states and localities taking steps to battle the pandemic, even in times of emergency, when reasonable and temporary restrictions are placed on rights, the First Amendment and federal statutory law prohibit discrimination against religious institutions and religious believers. The legal restrictions on state and local authority are not limited to discrimination against religious institutions and religious believers. For example, the Constitution also forbids, in certain circumstances, discrimination against disfavored speech and undue interference with the national economy. If a state or local ordinance crosses the line from an appropriate exercise of authority to stop the spread of COVID-19 into an overbearing infringement of constitutional and statutory protections, the Department of Justice may have an obligation to address that overreach in federal court.

I am therefore directing the Assistant Attorney General for Civil Rights, Eric Dreiband, and Matthew Schneider; the U.S. Attorney for the Eastern District of Michigan, to oversee and coordinate our efforts to monitor state and local policies and, if necessary, take action to correct them. They should work not only with all Department of Justice offices and other federal agencies, but with state and local officials as well.

I voted for john Cox. That’s how much I agree with Newsome’s agenda. However, I support this extended SIP, because it’s working. The number back it up. New Zealand has almost zero cases of Covid-19 now. ZERO. 12 reported deaths from a population of 50 million. Why? Closed the boarders and strict SIP. Stay home. The life you save may be your own.

The population of New Zealand is under 5 million. Comparing a geographically isolated island with a population that’s 1.5% of the size of the USA is not a valid comparison.

Why are there counties in Northern California asking to reopen now? Why are Sacramento residents suing the Dictator to reopen? Why are people at the beach in Southern California?

And btw, Why is it assumed that a shelter-in-place is the “smart” way to deal with this? The order has had no benefit or even a negative benefit on the virus. The secondary, economic and social harm caused by the quarantine only makes the idea worse.

The curve has flattened. SIP did what it was supposed to… It bought us time so that hospitals & health care workers could prepare for large number of sick people. Only thing is, the hospitals are empty & furloughing/laying off employees.

They need to gradually re-open California, not tighten the noose.

In CoCo County, we have 1,080,000 residents. Only 23 people have died of COVID. The Shelter-in-place has served it’s purpose, to allow hospitals to prepare, obtain employees, materials, ventilators, isolation, etc in place. We now have more streamlined COVID testing.

The elderly and high risk, immunocompromised, pregnant and new babies should absolutely continue to shelter in place as best as they can, however,

So REOPEN CALIFORNIA! We can start carefully, limiting the number of customers inside a restaurant, but let’s start! Waiters, hair stylist, Carpenters and workers of all types need their income back and to have a purpose to their day.

Governor Ken Doll is going to run smack dab into that pesky old Constitution real soon. You can only impinge fundamental rights (Google the list, folks. It’s not short) by the least restrictive means and only to serve an “essential governmental purpose”.

That means Shasta and Los Angeles counties can’t be under the same lockdown conditions much longer, and it means that Ken Doll can’t use unproven risk to fine you for moving about (a fundamental right).

I think any business where the risk to the workers and public could reasonably be lowered should be allowed to function if they can.

A big problem seems to be the lowest wage earners, most seem to be low skilled individuals who are desperate for work and accept any wage offered them. This squeezes out citizens who won’t accept the very low standard of living Business owners capitalize on this to maximize profits.These people need to form unions so they can put pressure on companies to pay fair wages and provide paid leave. Fast food franchises have wide profit margins and anybody who eats fast food can afford to pay an extra buck or two for their meal.
