Bay Area Serial Burglary Suspect Free Without Bail Despite Alleged Crime Sprees

A serial burglary suspect with a long criminal history is free without bail despite allegedly being involved in a recent string of burglaries in Fremont, Milpitas, San Jose, Santa Clara and Palo Alto, Fremont police said.

Kristopher Sylvester, 34, of Fremont, was arrested by Fremont detectives on April 2 for allegedly committing multiple commercial burglaries, possessing a loaded firearm, evading police and violating his probation, according to police.

Sylvester was booked into Santa Rita Jail in Dublin, but an Alameda County Superior Court judge released him without bail on April 7 after he was arraigned. The judge set a court date for Sylvester in June.

The judge’s action stems from a new California Judicial Council policy of releasing without bail suspects who are arrested for misdemeanors and low-level felonies in an effort to reduce overcrowding at jails in the wake of the new coronavirus pandemic.

Sylvester was arrested again by Santa Clara police last Thursday for allegedly engaging in a crime spree in Santa Clara County, according to Fremont police.

But when Sylvester was arraigned on Monday, a Santa Clara County Superior Court judge freed him without bail again and set a court date for June, Fremont police said.

Sylvester and other suspects allegedly burglarized a Hertz car rental facility in San Jose on April 13 and stole about 60 car keys and 23 vehicles, according to police.

Later that morning, Milpitas police responded to an auto burglary in their city in which the suspect vehicle was one of those stolen from the Hertz facility in San Jose, Fremont police said.

The suspects left behind two cash registers that were stolen from a burglary in Palo Alto earlier in the day, according to police. Surveillance video from the Palo Alto burglary led Fremont detectives to identify
Sylvester as one of the suspects in the case, police said.

At about 2 a.m. last Thursday, Santa Clara police who responded to several burglaries in their city located a suspect vehicle that had been stolen from the Hertz facility in San Jose and chased it, police said.

The suspect’s vehicle drove the wrong way on the San Tomas Expressway but eventually crashed, and Sylvester was arrested along with 32-year-old Jacob Mauch of Fremont, according to police.

In connection with the Santa Clara case, Sylvester and Mauck are charged with two counts of burglary, possession of stolen property, felony evading, committing a crime during a state of emergency, possession of burglary tools, resisting arrest and violating their probations.

On Thursday, Milpitas police recovered two more of the vehicles that were stolen from the Hertz facility and arrested 27-year-old Cody Ward and 35-year-old Jana Cornehl, both of Fremont, police said.

According to Fremont police, Sylvester has multiple arrests for firearms possession, burglary, possession of drugs, identity theft, possession of stolen vehicles and felony evading and was on probation for two previous offenses.

They said Mauck has prior arrests for assault with a deadly weapon, battery causing significant injury and robbery, Ward is on probation for possession of a stolen vehicle and Cornehl is on probation for identity theft.

Sylvester, Mauck and Ward were all released without bail at the hearing on Monday. Cornehl was released with a citation.

What I think is that the criminals know that there is a high risk of Covid in jails. And they know they can pretty much do what they want and get free the same day.

In my opinion, if they risk jail, they should get it and live with the risk of Covid. They are choosing to play with fire.

The so what is, this. Sylvester did not bail out of any of his 3 arrests. He was OR’ed.

Since he stayed in custody at Santa Rita for 5 days on his first arrest, if Sylvester had the capability to make bail he would have done so prior to his hearing. The only reason why he is free is because he was OR’ed.

Yes you are correct, bail is not punishment; however, when you cannot make bail, County jail does a pretty damn good job at preventing people from continuing their criminal ways on the street don’t you think?

US has more people behind bars per capita than every country in the world, including China and Russia (who aren’t known for being soft). So if locking people up was the solution how come it hasn’t worked?

Doesn’t matter if there are more people incarcerated than somewhere else-what matters is the a POS like this gets released to do the only thing he knows. Obviously we need more prison space, or a Federal Judge wouldn’t hand down a ruling that we need to reduce crowding in our state prison system. By loosening the bail system (another left wing dream), he’s free until his trial.

I know, it stinks when actual FACTS get in the way of your opinion. Sure China does some shady stuff but they aren’t doing it to someone who steals a TV. They are putting activists and people that speak up against the government into secret camps, I mean there’s no need to “hide” the fact that you’re putting an actual criminal in jail. Plus you don’t even have to look at China, there’s no correlation between numbers incarcerated and the crime rate if you look at the history in the US. I’m sure you’ll dismiss facts because you’re more concerned with complaining then actually learning something.

Our “so-called leaders” are probably related to one or more of these criminal types. Look at London Breed, Mayor of San Francisco. One of the first things she did when she took office was to try to get her brother, sentenced for manslaughter, released from jail. San Francisco District Attorney, Chesa Boudin, had parents that were incarcerated for murder committed during a robbery while they were members of the notorious and violent Weather Underground They are bleeding heart liberals because they know the perpetrators so well, their relations, kin, second-cousins, parents, siblings, children. The ties that bind! Makes me wonder who the black sheep in the family could be in the Pelosi and Newsom family tree.

I agree that more crimes are happening now because offenders know they will be let out to commit more. Meanwhile honest law-abiding citizens are living in fear of these repeat offender, sometimes machete wielding criminals showing up to their homes.

Just like the guy that was arrested last week in Concord on several charges, including theft and evading police. He has an extensive criminal record and according to his social media had just started working a job at a very large chain grocery store in the Butcher Dept. A felon with access to Butcher tools at work! Great background check this BIG chain grocery store has if that is true!

We deserve better than this.

This is wrong on so many levels. When you have a repeat offender that still doesn’t understand the rule of law no matter how many times you arrest him and then throw him back onto the streets to offend again, society has lost. Throw his @$$ in jail. He has the potential to do great harm, because he was caught with a weapon and he has been shown that you can get away with almost anything and the law just looks the other way. When you have a society where punishment is lax you have a society that has run amok.

Can’t blame the judges when the Dem controlled State has passed laws that limit sentences and punishments. The no bail thing I understand and agree it’s a punishment before conviction but the problem is it should not be for career criminals. At the least it should be changed so someone recently arrested and OR’d does not get released prior to their court date of their first arrest.

County jails in ALL of California’s 58 counties have been releasing convicted misdemeanor criminals long before their sentences are served because of jail overcrowding, since 2011. Revolving door incarceration.

Those on Parole from state prison used to go back to state prison, usually for a year, if they violated their parole.
Except in a very few cases, since 2011, the most they can get for a parole violation is 180 days county jail time.

BUT because of county jail overcrowding they are often turned back onto our streets in a matter of hours.

To all the people complaining about criminals getting light/no jail time, I bet you’d also complain about having to pay for increased jail times i.e. more jails and more guards. And don’t use that “I already pay taxes” argument or that “Guards are over paid” or “Union labor makes building prisons too expensive” etc. It is what is. Put up or shut up.

Bad boy should be in jail. Sick and tired of trying to understand our justice system at times. He is trouble and needs to pay for the misery he causes others. I find it amazing how we have let these criminals to reoffend. It costs so much time and money to arrest them, court costs etc. How can we afford to let this happen all the time? There are thousands of these people out. Just think of how many innocent people he his hurting. Stealing our stuff?

Betcha he doesn’t show up for his June hearing as he will be to busy continuing to rob and pillage until then. He is endangering the lives of all of us and law enforcement. There has to be a special place for these losers in the after life since there are no laws that keep them in prison where they should be during their lifetime. He does not want to change and knows he can get away with anything and everything.

No bail. So why dont we use ankle bracelets or drones when being released with no bail. Its probably cheaper to have a drone follow this guy around then to keep him in jail. A drone would end his criminal career and his criminal friendships.

The police should just park their cars, go home, and shelter in place! Why bother forcing them to contact people and risk catching the virus if this is the outcome? on probation for felony, while on probation for a felony, caught with fire arm in a stolen car after trying to evade police by reckless driving and they let him go. sounds like he needs to be put down with a small caliber round through the head. do us all a favor
