California Chief Justice Suspends Jury Trials Statewide For 60 Days

California Chief Justice Tani Cantil-Sakauye on Monday evening ordered all jury trials in the state superior courts suspended for 60 days in light of the COVID-19 coronavirus pandemic.

The chief justice said courts are not able to operate as usual while observing social distancing and other health directives of federal, state and local authorities.

“Courts cannot comply with these health restrictions and continue to operate as they have in the past,” Cantil-Sakauye wrote in the order.

The order allows some exceptions. It says superior court trial judges may conduct trials during the suspension “upon a finding of good cause shown or through the use of remote technology, when appropriate.”

The chief justice wrote in the order that in addition to courts’ difficulty in providing for social distancing during trials, the closure of schools means that many court employees, trial participants and potential
jurors must stay at home with their children.

“These restrictions have also made it nearly impossible for courts to assemble juries,” she wrote.

As chief justice, Cantil-Sakauye chairs the San Francisco-based Judicial Council of California, the rule-making body of the state court system.

“The World Health Organization, the United States Centers for Disease Control and Prevention and the state of California have recognized that the world, country, and state face a life-threatening pandemic caused by
the COVID-19 virus,” Cantil-Sakauye wrote.

1st Amendment
– the right to peaceably assemble…

6th Amendment
– The right to a speedy and public trial by an impartial jury of the state and district wherein the crime shall have been committed…

A lot of defendants waive their right to a speedy trial and the article mentions there will be some exceptions.

Does anyone else find it funny that democrats tried to impeach Trump for holding up aid to the Ukraine but they are holding up aid to the US.

Not funny and totally different circumstances if you read the details. McConnell want one half trillion dollars in a slush fund for companies chosen solely by Mnuchin with no over site and no strings. Democrats want over site and conditions like not using the money for stock buy backs.

DOH
Corporations employ millions of people in the US and it is imperative they survive. What they get are loans with restrictions on what they do with the money they borrow and have to pay back. For instance no bonus money for heads of corporations.
Democrats want things like the green new deal and president Trump approving Obama care, airlines to improve their emissions, tax credits for solar panels and many other things that have no connection to the problems brought by the coronavirus. In other words they are blackmailing the Republicans to get in their diversity schedule.

“Be just what you is, not what you is not. Folks what do this has the happiest lot.”

A fav of mine. Without looking it up; name the source!

HUMmmmm this was in response to Yogurt’s post. It seems to have disappears, but…

Any guesses???

Uncle Remus?

No, but that was a great guess, Richardo.

Anyone else?

People, people, when will we stop arguing over the politics? Ugh, there is always one party or the other holding things up on Capital Hill. The question is, which party is it THIS time! We are ALL being held hostage while we wait for them to bicker like children until they get enough of what they each want. Oh how they must love to see The People turn on each other instead of on them! On another note, I just got a jury duty summons last week for April 13th!
