On the heels of the failed effort to repeal San Francisco’s e-cigarette ban, Congressman Mark DeSaulnier (CA-11) announced the introduction of the Preventing Vape Use Act, a bill to immediately halt the sale of all e-cigarettes nationwide until they undergo a pre-market review by the U.S. Food and Drug Administration (FDA).
The NIH reports that more than 3.6 million children used e-cigarettes in 2018 alone.
“For nearly a decade, the FDA has allowed e-cigarettes to go largely unregulated, setting the stage for today’s epidemic of e-cigarette use. While escaping regulation, the industry profited off the backs of those teens to the tune of $7 billion in annual sales. With more than 1,300 people having gotten sick with vaping-related lung injuries this year, we owe it to our children to hold these companies accountable and stop the sale of these devices until the FDA can certify that they are safe,” said Congressman DeSaulnier.
Cities across the country, including Richmond and San Francisco have already passed ordinances banning the sale of e-cigarettes pending their review by the FDA. The Preventing Vape Use Act goes one step further by requiring that companies producing these products issue recall notices, effectively warning the public of the dangers of e-cigarettes.
“Vaping products have caused enough damage, killing dozens, hospitalizing thousands and addicting an untold number of our nation’s youth. It’s time to remove them from our shelves until they are deemed safe,” said Joel J. Africk, President and CEO of the Respiratory Health Association.

Shouldn’t he be focusing on existing law? In most states it’s already illegal for anyone under the age of 18 to purchase e-cigarettes and in some states, including California, the legal age is 21. Enforce existing laws before placing an outright ban.
Banning a product that people enjoy will only create more crime by creating a black market. If Mark knew anything about the failed 18th Amendment (prohibition), or the failed war on drugs, he would realize this.
I would agree that we enforce what we have but clean it up a bit. I mean it is illegal to sell, or provide e cigarettes and vape stuff, but did you know there is no law prohibiting the possession of this stuff by a minor????

Vaping is illegal for minors to buy and possess. Crack down on the sellers and those adults who buy it for the minors. Treat these people the same as someone who buys beer for a minor.
Mandate warnings on packaging and advertisements, just like with tobacco products. If the adult decides to ignore the warning, then it’s the adult’s decision.
We all know that vaping is bad for you, just like we all know that tobacco, alcohol, red meat, junk food, fast food, marijuana, candy, soda, etc. are bad for you. But quit perpetrating the Nanny State on responsible adults and LEAVE US ALONE! If the adult wants to slowly kill themselves, then that is the adult’s decision.
I’m surprised that Mark has not introduced a bill that mandates 60 minutes of strenuous exercise per day (monitored by Big Brother, of course) to combat obesity. Maybe that’s next.
Hmmm… leave cigarettes alone, which are proven to cause many thousands of deaths per year, but ban e-cigs because a handful of people die. I don’t do either but it doesn’t seem to make much sense.
I agree. Every time I read an article about vaping causing illness it has always said it was from black market product. I know plenty of adults who switched to e-cigs and are happy to no longer smell like cigarette smoke. They’ve tried and tried to quit smoking and it never worked.

Mark D out here writing laws for big tobacco, who realize e-cigarettes don’t require tobacco as a delivery device for nicotine, which would make their vast tobacco fields relatively worthless.

Inhaling chemicals straight into the lungs is not really a good idea.
If the impact was only to the user – then great – be a test subject for the company…
Otherwise, when they start getting sick – insurance rates go up and it impacts me when I have to pay my share of insurance.
IMHO – we should ban both but the Tobacco company is very entrenched which makes it very hard to do…
e-cigs are more recent and we can deal with it now rather than wait and then it will be entrenched like tobacco…

Amaziing! I don’t believe we heard a peep from DeSaulnier when California was considering legalizing marijuana use. So, I guess we can assume he’s all for marijuana use, but tobacco use is another thing. In fact, this might explain … oh well, nevermind.

Popcorn – got a couple of thoughts for you to ponder….
1. If you “cannot stand to read the hateful comments on this thread”, then DON’T READ THEM.
2. You characterize the posters (or comments) as “so boring.” Yet you continue to read them and insult the bloggers. Nothing less than hypocrisy on your part.
3. The FIrst Amendment (Bill of Rights in the Constitution) protects freedom of speech. Ever hear of it? Why are you trying to deny others their opinion?
4. “Bully monsters are gritting their teeth for no reason” – There are PLENTY of reasons, given his proclivity to take an uninformed stand on numerous issues of relatively low priority. Given the number of issues out there today, vaping is a pretty small problem in comparison. But Mark has NEVER been one to take on substantive issues since being in DC or in Sacramento – or, for that matter, as a member of the county BOS.
5. Insulting those who take a contrarian opinion as “haters” or “bully monsters” tells me that you’re nothing more than a “hater” yourself – and NOT willing to hear others. In other words, you’re blinded by the party line.
Right – Mark won the election by a majority in Contra Costa County. He rode in on the coattails of George Miller, and certainly not by any efforts/knowledge/experience of his own. As I’ve said before (and some democrat politicians have said) – many would vote for whoever had a “D” after their name, regardless of their capabilities, knowledge or experience. As Nancy Pelosi said (referring to democratic districts), “But those are districts that are solidly Democratic. This glass of water would win with a D next to its name in those districts.” That tells me a LOT about the mentality of democrat voters and supporters, especially in the heavily democratic areas of California.
All the above being said – you might what to halt the insults and open your mind and try some critical fact-based thinking instead of just voting the straight party line. Idolizing a politician is (frankly) kinda creepy.
And as Rollo noted – you might want to relearn the English language and grammar if you want to be taken seriously. But until Mark does something substantive, he won’t be taken seriously by those with critical thinking skills.
