A California bill that pushes for harsher penalties against people who buy sex from children moved forward Tuesday, but not without a fight between members of the public safety committee and the bill’s author Republican Senator Shannon Grove, according to a report from CBS News.
The original bill, authored by Grove, would make soliciting a minor for sex, agreeing to engage or engaging in any form of commercial sex with a child a felony offense with a sex offender registry required on repeat offenses, CBS News reported.
However, Democrats on the public safety committee amended the bill to exempt 16- and 17-year-olds from the penalties and reduce the punishment from two years in prison to up to a year in county jail, according to the report.
Here’s what Senator Grove had to say about the changes:
What I proposed in Senate Public Safety with SB 1414:
• Make the solicitation, or purchase of children for sex a felony with prison time.
• Up to $25,000 fine.
• Sex offender registry for repeat offenders.
What three members of the Senate Public Safety Committee did with their forced amendments.
• Make the solicitation or purchase of children for sex punishable by a wobbler, which can still be charged as a misdemeanor, punishable by as little as 2 days in jail OR up to a $10,000 fine.
• Can be charged as a felony ONLY if the child being purchased is 15 years old or younger, but still the buyer is ineligible for prison (jail time only)
. This excludes 16 and 17 yr olds from additional protections (still a misdemeanor) to purchase them for sex.
• If a buyer has a previous conviction of purchasing a child under 16 years old and is convicted on a second offense of buying child under 16 years old AND …. the victim and buyer are more than 10 years apart in age, the buyer would register as a tier one sex offender for (10-years).
I don’t understand why protecting children in this state from sexual predators is so incredibly difficult.
Please keep in mind you have to be 18 years old to buy a lottery ticket.

Scott Weiner’s opposition comes as no surprise whatsoever. He is responsible for the law allowing men, many of them violent sex offenders, to be housed in women’s prisons. He is also responsible for the law that says police cannot stop or cite someone for loitering, which has led to explosions of open prostitution in many California cities (notably San Diego) and child trafficking. He seems to despise women and children, and sadly, is very effective.
Have they offered any king of rationales to defend this absurd position?

From the /b Sacramento Bee /eb , Nancy Skinner, D-Berkeley “The problem with how it’s constructed now is it is not designed solely and only to get those persons who are being sex trafficked,” Skinner said. “Additionally, it goes after individuals who have not … actually engaged in in any way.” Other lawmakers agreed, saying Grove’s version of the bill was too broad. “This bill will send people to state prison, put people in the sex offender registry — which is basically, effectively, in many ways, the end of their life for people — whether or not they’re engaged in human trafficking,” said Sen. Scott Wiener, D-San Francisco.

“Opponents of Grove’s bill said it was too broad and could sweep in teenagers having sex with other teenagers who exchange gifts or take actions that could be construed as soliciting. They also said the law could be used to target the LGBTQ community.”
The only thing that Dems want to protect kids from is critical thinking, common sense and reality.
