A Concord man will spend a year in jail after he pleaded guilty to child sex trafficking and other related crimes, according to the Contra Costa County District Attorney’s Office:

The following is from the D.A.’s Office:

Manuel Gomez-Antonio (39-year-old resident of Concord) was convicted by plea of child sex trafficking and related crimes arising from a joint affirmative enforcement operation conducted by Contra Costa’s Human Trafficking and Internet Crimes Against Children Task Forces in January of 2019.

Gomez-Antonio was convicted and was sentenced to serve a year in county jail. Honorable Leslie G. Landau accepted the plea agreement and sentenced the defendant. His three-year probation supervision terms include a 100-yard stay-away order from the Concord park, prohibitions against using or possessing any on-line dating applications, and search and seizure terms that include all digital devices.

Using an online dating application, the defendant offered to pay what he believed to be a 14-year-old boy to perform a sex act in a Concord park. The “boy” was an undercover police officer. The defendant was arrested by officers when he drove to the pre-arranged meeting location by the tennis courts in the park.

I wonder how long he had been in jail waiting for trial and conviction.

The time spent in jail is doubled and then subtracted from the sentence.

It could be possible that Manuel is walking the streets on probation right now.

There is one and only one cure for Manuel’s sickness.

A sentence of one year?

DA Becton must like the guy.

He was convicted of Penal Code Section 236.1(c) and 288.4(b).

236.1(c)
(c) A person who causes, induces, or persuades, or attempts to cause, induce, or persuade, a person who is a minor at the time of commission of the offense to engage in a commercial sex act, with the intent to effect or maintain a violation of Section 266, 266h, 266i, 266j, 267, 311.1, 311.2, 311.3, 311.4, 311.5, 311.6, or 518 is guilty of human trafficking. A violation of this subdivision is punishable by imprisonment in the state prison as follows:
(1) Five, 8, or 12 years and a fine of not more than five hundred thousand dollars ($500,000).
(2) Fifteen years to life and a fine of not more than five hundred thousand dollars ($500,000) when the offense involves force, fear, fraud, deceit, coercion, violence, duress, menace, or threat of unlawful injury to the victim or to another person.

288.4(b)
(a) (1) Every person who, motivated by an unnatural or abnormal sexual interest in children, arranges a meeting with a minor or a person he or she believes to be a minor for the purpose of exposing his or her genitals or pubic or rectal area, having the child expose his or her genitals or pubic or rectal area, or engaging in lewd or lascivious behavior, shall be punished by a fine not exceeding five thousand dollars ($5,000), by imprisonment in a county jail not exceeding one year, or by both the fine and imprisonment.
(b) Every person described in paragraph (1) of subdivision (a) who goes to the arranged meeting place at or about the arranged time, shall be punished by imprisonment in the state prison for two, three, or four years.

The guy should have got 5 years in state prison minimum.

And it makes no difference under the law if the boy was willing or said he was 18. The law is very clear on that.

DA Becton cut this guy a break probably because he’s non-white.

Under 288.4(b), the guy should get one year in county for just arranging the meeting. But he was caught at the park. He showed up, so he should get 2-4 years in state prison just for that. And for 236.1(c), 5 years minimum in state prison.

You think he did not get a favorable outcome?
