Lawmaker Proposes Bill To Facilitate Name Change On College Diplomas For Trans, Nonbinary Students

California Assemblyman David Chiu, D-San Francisco, on Thursday proposed a bill that would allow transgender and nonbinary public college students to use their preferred names instead of their birth names on diplomas.

According to Chiu, recently introduced Assembly Bill 245 will ensure that diplomas don’t mistakenly use a graduate’s birth name, if they prefer to use a chosen name.

Chu said the bill is especially important since transgender and nonbinary people face higher rates of discrimination in the workplace. Not having their preferred name on their diploma can create even more challenges, especially if the individual chooses not to openly identify as transgender or nonbinary at work or school.

“Making sure college records reflect a student’s name is a no-brainer,” Chiu said in a statement.

“Transgender and nonbinary students face many challenges, and this simple policy will ensure they have one less barrier to overcome.”

The bill aims to standardize the process for updating records after a student graduates, as the system varies across all of the state’s public colleges. It builds off of AB 711, authored by Chiu and signed into law in 2019, requiring that K-12 school districts update the diplomas and transcripts of former students to reflect their updated names and gender markers.

AB 245 is being backed by LGBTQ civil rights organization Equality California.

“Deadnaming — or referring to someone by the name they were assigned at birth instead of the name they currently use — is a traumatic and unnecessary experience faced by far too many transgender and nonbinary Californians,” Equality California executive director Rick Chavez Zbur said. “This small but important act will help ensure all of our students are treated with the dignity they deserve.”

Well done. As that is an official document that is used for legal purposes such as credentialing and background checks I’m sure it won’t create any problems that someone can electively put whatever name they choose on their diploma. I am going to graduate as Diplomy Diplomaface. I fully understand the existing ability to legally change my name ahead of my diploma thus allowing me to have it read what I prefer but this plan is WAAAAY better.

A diploma should have the name of the person that graduated at that time. It’s a document for that period of time in a persons life. This whole th8ng is getting ridiculous

I had to look up Nonbinary. For those who want to learn some new terms, here are all the definitions that fall under Nonbinary. There will be a test at the end.

Agender – having no gender or being genderless
Androgyne – identifying somewhere in between man and woman
Bigender – having two gender identities, either at the same time or interchangeably
Demiboy – partially, but not completely, identifying as a man, boy, or masculine person
Demigender – having partial connection with one gender (male, female, or other)
Demigirl – partially, but not completely, identifying as a woman, girl, or feminine person
Enby – a slang term to refer to a non-binary person, not all non-binary people identify with this term
Genderfluid – moving between two or more gender identities at different times, in different circumstances, etc.
Genderqueer – a non-normative or queer gender, having no exclusive connection to any gender
Multigender – having more than one gender
Neutrois – neutral or null gender, similar to agender
Non-binary – an umbrella term to describe people whose gender is neither man or woman; can also be used as an individual gender identity for someone who is neither a woman nor a man, but does not identify further
Pangender- having many or all genders within one’s culture
Transfeminine or Transfem – a person assigned male at birth (AMAB) who identifies with a feminine gender, but does not necessarily identify as a woman
Transmasculine or Transmasc – a person assigned female at birth (AFAB) who identifies with a masculine gender, but does not necessarily identify as a man

I can understand wanting to be accommodating when possible, but transcripts, diplomas, are a matter of fact checking. Hard to check that if people are simply picking names.

What about people that haven’t selected their preferred gender? Do they get documentation in both?

Not saying trans people are deceitful, but the idea of people being able to select their name on their official documentation would seem to be rife for fraud…get documentation under both names and now you can sell one…

Finally, completely agree that we have much more pressing things in this state than this.

You do realize job application verifications ate all computer based, so the mismatch will trigger a NO interview right off the bat.

The author of the original article did a bad job explaining this bill. A person must provide documentation that they have legally changed their name, before getting their name changed on their diploma.

A person can’t just have their preferred name on a diploma like this article implies. A person must have their legal name on the diploma.

From the text of the bill: “This bill would require a campus of the University of California, California State University, or California Community Colleges to update a former student’s records to include the student’s updated legal name or gender if the institution receives government-issued documentation, as described, from the student demonstrating that the former student’s legal name or gender has been changed.”

Natalie that makes sense. But I just looked up UC and state policy and it said if you legally change your name they already replace it, obviously you have to return the old one.

They also update their records, again once proof of legal name change is completed.
