Northern California Assemblyman Blasts Gov. Newsom, Shelter-At-Home Plan

California Assemblyman James Gallagher, who successfully sued Governor Newsom for abuse of power during the pandemic, issued the following statement in response to Newsom’s new shelter-at-home order.

“The only thing consistent with the Governor’s handling of COVID-19 has been his inconsistency.
 
He started with the essential vs non-essential game. Then he took us into a statewide lockdown after promising local control. Next was his color-coded Gummy Bear fiasco. And now we’re back to another arbitrary lockdown without the evidence to back it up.
 
When you combine this inconsistency with hypocrisy, the end result is a complete lack of trust. 
 
Government lockdowns do NOT reduce cases or stop spikes. Neither science or reality justify the Governor’s announcement today – just look at how California’s case count compares to less restrictive states.
 
We know that this virus hits our most vulnerable populations the hardest. Yet, under the leadership of the California Department of Public Health and Governor Newsom, we’re still seeing outbreaks at senior living facilities. This is insane and shows a complete failure of leadership.
 
The other important thing to do is to make sure our healthcare infrastructure is ready to respond. Instead of arbitrary mandates on small business, the Governor should be spending his time marshaling resources and ensuring we have emergency healthcare workers to help with additional staffing needs.
 
Unlike changing laws (see Gallagher/Kiley v. Newsom), his power under the Emergency Services Act does allow the Governor to make critical healthcare preparations and protect our most vulnerable populations.”

I mean… When you are right, you’re right. Well said on all fronts. Newsom and our health department are completely incompetent and had an entire lockdown and gradual opening up to get this right. Change of leadership is needed.

Like which ones? From NYTimes… weakest restriction states are SD, IA, ND, OK, and ID… all in the top half of new cases by state.

CA is in the top 10 for restrictions and has half the per capita new cases as OK.

Public health and economic health are at odds with each other and Newsom needs to find the right balance and that is a damn hard and thankless job. Gallagher couldn’t tell a fact from Shinola.

Because what would really work is fasting and prayer like they have in Oklahoma! (seriously that’s what their Gov is counting on)

Except in the spring they locked down LA, and it continued to have case count growth until it had the most cases of any county in the country, if I recall correctly. Meanwhile in the spring, South Dakota did not lockdown, and saw barely any Covid spread.

I’m personally somewhat agnostic about the effects of lockdowns. They probably mitigate spread a little in the short term, but are just delaying the inevitable in the longer term. But you can cherry pick data to see it either way.

To Claycord…..I read your statement from CCCOS. It’s a bit obtuse and unclear. Some might even say the Sheriff’s Dept. provided a non answer to the specific question. So, in your opinion, will the Department enforce, or not enforce Gov. Newsom’s new policy.

Gallagher has NOT successfully sued the governor, either. The injunction issued by the trial court was almost immediately stayed by the court of appeal pending further appeal, a pretty sure sign the court will reverse the trial court.

They did successfully sue him; the judge ruled in their favor. Kiley and Gallagher deserve recognition for their David and Goliath effort. They knew he would pursue a more sympathetic court afterward.

Also, I note here that instead of a central coast region, the state split it with Monterey and Santa Cruz included in the Bay Area Region. SLO and Santa Barbara into the southern region. The Bay region is possibly accelerated to the lockdown due to higher case and hospitalization rates in cities such as Salinas.

Not every lawsuit is about money. Some are about principle. In this particular case, it was about the illegality of Newsome’s executive orders and how he was creating new law when only the legislature can.

Our system has three branches, each with distinct responsibilities. The Legislators (House and Senate) create the laws. The executives (President, Governor) ratify the laws. The judges rule on the constitutionality of the laws.

Gavin decided to drive in the legislative lane. The judicial “cops” gave him a warning.

Can see why some might not like what the assemblyman said, those getting their “facts” from social media or liberal alphabet media. Those who have been following this states Knee Jerk moves, following moves of other DEM governors realize the assemblyman is correct.

For instance sending covid patients not needing in hospital care to nursing homes.

Biggest problem in CA is it’s many citizens far more interested in number signal bars their hand held device has, than in news of what is happening in our state. An they’re certainly not interested in providing adult supervision to those they voted into office.

You know, I wouldn’t be half bothered by shutting down when ICU availability falls below 15% for CCC….especially if CCCHS would list all of the subject hospitals in the County, their ICU occupancy capacities and availability….and we gotta a lot of hospitals.

But, they won’t, it will be arbitrary, maybe even capricious.

He’s correct, additionally, those decrying “Follow the science!” should also follow the science that the PCR test, as used under CDC guidelines, has an almost 97% false positive rate. The Danish mask study has shown masks are ineffective. The CDC has stated the incubation period is now 7-10 days; this current “Surge” may be from Thanksgiving. The Thanksgiving “Surge” will not be seen at Christmas time (contrary to what newsom has said). All he did was move the goalposts; keep the fear mongering up in order to continue his intoxication via power over you.

Nobody had anything to say about Trump and his disaster of the Covid pandemic but let there be a Democrat in charge and it’s all his fault. Enjoyed a lovely week at Walt Disney World in Florida last month. 4 flights + multiple days in the theme parks + indoor dining and NO ONE got Covid. Even got tested a week following the trip to be safe. Florida has managed to find a way to keep things open with masks, social distancing and plexiglass. CA businesses follow all the guidelines, invest thousands of dollars in tents and heaters and still get screwed.

We sent Gavin a postcard from FL…I’m beginning to think he may not have appreciated it.

Maybe if Newsom spent more time allocating public health funds during the first lockdown and gradual reopening… He could have helped stem the “second” wave. Instead he ate at the French Laundry, the most prestigious restaurant in the state. Instead over half of ICU cases and deaths have come from long term living facilities… Which bolster the numbers. So tell me? What will locking down the already deadly blitz on small business achieve? Nothing. Didn’t work before, won’t work now. This thing is out of control and will be for a while. Get real.

I think the lockdowns and mask mandates are ridiculous. I wear a mask where ever I go and I don’t gather or socialize I just go to work and the grocery store while wearing a mask and I am sick with COVID right now. It’s miserable like a flu and it’s sad for those who have lost loved ones, however, locking us all up isn’t the solution, seems like we will contract it regardless so let’s not kill our economy and mental health too.

Yes it has proven to be the answer! We the people are the enemy. The virus spreads from person to person. So obviously since some folks didn’t follow the protocols so we are in big trouble. Countries where they locked down slowed down the spread. Try New Zealand for example.
Our weekly get together here where I live was cancelled because we want to do our part. One of the neighbors in the group just had a cousin die from Covid.

They had a tablet outside the front door , you write down your name and phone number and wait in your car . They called when they were ready for me to come in . They took my temperature and had me use hand sanitizer and so did they . Everybody wore masks all the time . Does that sound like they are spreading covid ? These are the businesses the government and their so called experts are closing down . But you don’t care about them Covid is going to be with us for years to come . Please Ilovepopcorn tell us all how the response of the island nation of New Zealand with a population that is 2 million people less than just the 9 bay area counties alone and a landmass that is 1.2 times smaller than California compares to the US response with a population of 328 million and a landmass that is 3,558% greater.

How is it different to quarantine an island nation surrounded by water that is over 2500 miles from to its nearest neighbor compared to quarantining a nation with 2 porous borders of approx. 7500 total miles with the world’s largest economy and the world’s busiest ports of entry?

Please elaborate how the liberals would have reacted if Trump would have closed all point of entry (airborne & waterborne like New Zealand is currently doing along with closing our land borders with Canada and Mexico) and then guarintining each state for the other.

I am going to take a guess that either you or your spouse has plenty of money saved up from years of work. Enough saved that you do not have to worry about how the rent is paid, how to feed your family, or how you can afford Christmas presents. Better yet, I’ll take another guess that you have a nice government pension that will never run out of funds.

Please correct me if I am incorrect in my assumptions. But you sure seem to be one of those “I got mine” folks who can’t look past their social security checks to see and realize that there are literally millions of people who are literally on financial life support because of the draconian edicts that rain down from on high.

Of course we should all be worried about catching a disease, whether it be Covid or the common cold. But please stop chastising people who just want to be left alone. You are too busy worrying about dying that you have forgotten how to live. Does it really matter? Once Biden gets in I’m guessing there will be some decisions made at the federal level that will be worse than California’s restrictions. Then what are we going to complain about? Follow the rules people!!! Always tell my kids to follow rules and if you don’t like the rules well then be the one who creates them….get into that position or follow the rules given to you. Do we not see this is getting worse?

The article DLo points to is what I remember hearing from the conference “evidence” is overall spread is happening and have a belief the prior lockdown was very successful. The “evidence” is not specific to what should be open/closed.
