City Of Oakland Imposes 18.5% Tax On All BART Parking Fees Collected Within City Limits

The City of Oakland is now requiring that an 18.5% tax be imposed on all parking fees collected in the City of Oakland, effective July 6, 2020.

Because of this new parking tax, the new daily fee including this tax for parking at Coliseum, Fruitvale, Lake Merritt, Macarthur and Rockridge will be $3.55.

The new daily fee at West Oakland will be $12.40.

All of the net proceeds from the additional fees collected will go directly to the City of Oakland. BART will not receive any additional revenue from this new tax.

Did the Oakland public have a chance to vote for this TAX on fees? I’m confused about taxes on fees for what is suppose to be a public agency.

Great idea! They should also put fencing around the BART stations and charge $20 admission. Kill the Beast. Drive it to bankruptcy and start over again, this time with goals of providing safe, clean and affordable public transportation, instead of the goal of maximizing the pensions of overpaid train operators. The Washington DC metro is more extensive, clean, and half the price of BART.

Let’s encourage people to take public transportation and then add lots of fee’s/taxes/fare increases. What could go wrong? I still want to be a janitor workign for BART so I too can make $400k a year. Notice how BART just swept that under the rug?

Just one more indication that it is time to evacuate California. Frankly, I am not interested in going to Oakland for anything except the Airport. Which reminds me, Does Oakland tax the parking fees at the airport?

Boycotting Bart! They are money grubbers from the get go. They receive tax revenue from multiple sources, constant increased ticket prices, new parking fee rates etc. Besides who wants to be encased in a mobile Petri dish like ginea pigs on those filthy trains! No thanks…..

Have to find a way to line the pockets again. I do not ride BART and do not agree with what they are imposing on people who have to rely on it to get to work. When I get a raise, state taxes, property taxes, HOA, PGE, and everything else goes up. I haven’t seen a raise on my paycheck in 15 years.

Does this new tax fall under Prop 218 that requires a majority vote for new taxes for the general good? Has there been a vote of voters within the Oakland district? Here is part of Prop 218 – note 1(a) & 2(b).

Article XIII C is added to the California Constitution to read:

ARTICLE XIII C

SECTION 1. Definitions. As used in this article:

(a) ”General tax” means any tax imposed for general governmental purposes.

(b) ”Local government” means any county, city, city and county, including a charter city or county, any special district, or any other local or regional governmental entity.

(c) ”Special district” means an agency of the state, formed pursuant to general law or a special act, for the local performance of governmental or proprietary functions with limited geographic boundaries including, but not limited to, school districts and redevelopment agencies.

(d) ”Special tax” means any tax imposed for specific purposes, including a tax imposed for specific purposes, which is placed into a general fund.

SEC. 2. Local Government Tax Limitation. Notwithstanding any other provision of this Constitution:

(a) All taxes imposed by any local government shall be deemed to be either general taxes or special taxes. Special purpose districts or agencies, including school districts, shall have no power to levy general taxes.

(b) No local government may impose, extend, or increase any general tax unless and until that tax is submitted to the electorate and approved by a majority vote. A general tax shall not be deemed to have been increased if it is imposed at a rate not higher than the maximum rate so approved. The election required by this subdivision shall be consolidated with a regularly scheduled general election for members of the governing body of the local government, except in cases of emergency declared by a unanimous vote of the governing body.

(c) Any general tax imposed, extended, or increased, without voter approval, by any local government on or after January 1, 1995, and prior to the effective date of this article, shall continue to be imposed only if approved by a majority vote of the voters voting in an election on the issue of the imposition, which election shall be held within two years of the effective date of this article and in compliance with subdivision (b).

(d) No local government may impose, extend, or increase any special tax unless and until that tax is submitted to the electorate and approved by a two-thirds vote. A special tax shall not be deemed to have been increased if it is imposed at a rate not higher than the maximum rate so approved.

SEC. 3. Initiative Power for Local Taxes, Assessments, Fees and Charges. Notwithstanding any other provision of this Constitution, including, but not limited to, Sections 8 and 9 of Article II, the initiative power shall not be prohibited or otherwise limited in matters of reducing or repealing any local tax, assessment, fee or charge. The power of initiative to affect local taxes, assessments, fees and charges shall be applicable to all local governments and neither the Legislature nor any local government charter shall impose a signature requirement higher than that applicable to statewide statutory initiatives.

Who work pay for those who don’t want to work. Fees on fees for people who can pay it. If they can afford fees then they don’t really need the money. California gonna give every person who not worth their weight in salt free everything cuz the poor guy who working will pay for it.

I wonder if Oakland’s parking tax is enforceable on BART property?

I haven’t done anything in Oakland for 20 years and have no plans to start.

So, I don’t care. And the last time I rode BART was 1989, so I care even less.

Of course, that’s on top of the crime tax imposed by anybody who has any business or reason to be in Oakland. Car break-ins, robberies, muggings, etc.
