Contra Costa County prosecutors decided Monday against filing charges at this time against anyone in the Halloween shooting in Orinda that left five dead.

Prosecutors said they met with sheriff’s officials Monday to review the case and made their decision.

The case is still under investigation.

Five suspects were arrested Thursday after authorities served search warrants in San Mateo, Marin City, Vallejo and Antioch. Four people were arrested on suspicion of homicide and conspiracy and one was arrested on
suspicion of being an accessory.

The shooting occurred at about 10:50 p.m. at a 4,000 square foot home at 114 Lucille Way.

Spokesman Scott Alonso, for the Contra Costa County District Attorney’s Office, said investigators need more information before filing charges.

Prosecutors have 48 hours to decide whether to file charges and that time was up Monday evening. All five suspects will be released.

Anyone with information about the case should call the Sheriff’s Homicide Unit at 925-313-2600.

This is the new norm for DA offices across the Country…Criminals are becoming more and more emboldened by soft on crime DA’s. Cops and crime victims are screwed!

mike November 18, 2019 - 8:09 PM - 8:09 PM

Let’s just hope and pray that none of these 5 kill or hurt anyone else while awaiting charges…… The DA was supported by George Soros’ organization(s) too, shocker……..

Carpe November 18, 2019 - 9:22 PM - 9:22 PM

Soros is pure evil, which I mean that with the utmost sincerity, but he is also a genius. He’s figured out that it’s not just the more prominent elections where he can affect his demented vision, but also with smaller local elections, especially DA’s…case in point being the freak who just won in SF, that lunatic is the literal spawn of kook leftist terrorists, and since they’re locked up, he was raised by fellow homicidal loons Bill Ayers and Bernadine Dohrn. And yes, unfortunately it’s true we have a similar psycho lefty DA here in CoCo.

If they were released as suspects in murders, why were their names/photo’s posted in the news?

How about a investigation of why the police did not respond to the initial calls before the shooting occurred. That’s the real crime here.

ON DA November 18, 2019 - 8:40 PM - 8:40 PM

Cause they weren’t invited either. Duh.

John P November 18, 2019 - 8:46 PM - 8:46 PM

You need to reread the earliest articles about the shooting. The two Orinda officers on duty (their normal complement) were recovering a stolen car in Oakland. You may think Orinda is a poor community and could not afford more than two patrol officers, but actually they didn’t need more than two until the owner decided to rent out their home to scum from otherBay Area locales..

How would police know a noise complaint would turn into a quintuple murder?

Be specific “how” in your answer.

Rollo Tomasi November 18, 2019 - 9:59 PM - 9:59 PM

Don’t feed the troll. TraumaRx does nothing here but offer unsupported opinions. Probably gets aroused when everybody responds.

TraumaRx November 18, 2019 - 11:09 PM - 11:09 PM

When you call 911 you expect LE to arrive and do their job right?

Jeff November 19, 2019 - 7:36 AM - 7:36 AM

TraumaRx,

Noisy party calls should not be made to 911, but to the regular complaint phone number. A low priority call when recovering a stolen call from a recent and local home invasion robbery.

Fred P. November 19, 2019 - 8:04 AM - 8:04 AM

TraumaRX – since you state that Orinda police didn’t respond to the initial calls and is therefore the “real crime”, I’d be interested to hear EXACTLY what “crime” was committed.

Be specific – PC, W&I, CVC, whatever – chapter and section. If you cannot identify the specific “real” crime, then you’re just blowing smoke. Don’t pretend to know something…you’ll look like an idiot.

SF oh November 19, 2019 - 10:19 AM - 10:19 AM

@ Trauma RX: It’s been explained a thousand times…. 1) Orinda doesn’t have a large police force with multiple units standing by at all times. 2). The Orinda police were assisting another city at the time of the call (I heard it was Oakland). 3) The call did not say it was a multiple, gang-related shooting ….. it was about party noise. 4) The Orinda cops do not have radios equipped with a crystal ball to tell them what is going to happen in the future.

Wherehaveubeen November 18, 2019 - 8:42 PM - 8:42 PM

TraumaRX,

Ummm they’ve released a report on that. Not sure what rock you live under but it was stated that they only have two officers on duty and were in Oakland helping Lafayette PD on a call and rushed back after hearing the call for the gun shots.

Googlar November 18, 2019 - 8:55 PM - 8:55 PM

Citizens take a back seat, criminals and illegals run this state now.

Carpe November 18, 2019 - 9:09 PM - 9:09 PM

@ Trauma
Uh, the “real crime” was lovely adherents of a certain wonderful subculture were busy gettin’ down and doin’ their thaang in the Lamo area. Orinda is pretty tiny and like two cops were on duty, you know that, right? So they were busy working on the Lafayette home invasion/assault/auto theft. The first couple calls for the Orinda party were noise complaints, first one around 9:20, email ~9:30, second call ~10:20…they are not going to prioritize that over the VIOLENT home invasion/recovered stolen car (found in Oaktown, shocker, I know) that needed to be secured and then wait for crime scene techs and tow truck. But once calls came in ~10:50 for shots fired, they left Oakland and were on scene at the Orinda house within 10 minutes.

FromClayton November 18, 2019 - 9:15 PM - 9:15 PM

California wants to be tough on gun crimes. Just kidding. They just want to take them away from conservative voters and let murderers and their accomplices free for optics.

DVC Student November 18, 2019 - 9:35 PM - 9:35 PM

Relax everyone:

D.A. has 72 “business” hours to charge someone after they are arrested. Suspects were arrested on Thursday & released Monday without being charged. Police arrest based on “probable cause.” D.A. charge based on “beyond reasonable doubt.”

The D.A. is still putting the evidence together & will re-arrest them. They will most likely remain under surveillance until that time.

Hayden Barsotti November 19, 2019 - 8:21 AM - 8:21 AM

If they can be found!!!!

Sign from Above November 19, 2019 - 12:54 PM - 12:54 PM

Wishful thinking DVC. These guys know they’re guilty and now know the police are looking directly at them. They are gone! It’s going to be a long time before they come up for air!

Just another example of the idiocy of the California electorate! You knowingly vote in a “soft on crime” DA and then you act surprised when something like this happens. Our DA believes everyone can be rehabilitated. Yeah right! You get what you get California. Just don’t cry when a repeat offender (or a released murdered) chooses you or your family member as their next victim!

Oh……and Trauma……..you’re an idiot!

Dr. Jellyfinger November 18, 2019 - 9:51 PM - 9:51 PM

Maybe we could have the House Democrats conduct their trial?
No proof necessary!
Evidence? Due process? Plbbt!
Who needs it?

Fred P. November 19, 2019 - 11:49 AM - 11:49 AM

They wouldn’t dare do it – they’d lose 5 of their voters…

Bob Foo November 19, 2019 - 1:01 AM - 1:01 AM

Innocent until proven guilty. I’d rather a thousand guilty people walk free than see one innocent person found guilty.

ChuckStir November 19, 2019 - 7:15 AM - 7:15 AM

Unless you are directly involved in this case there is no way to know why they were released. One can come up with many reasons and still not one of them could be correct. Maybe waiting for all the facts to come forth, if ever they do, then most of the comments here would have more meaning. Just saying.

Ricardoh November 19, 2019 - 10:09 AM - 10:09 AM

That is not what the sheriff said.

Kentucky Derby November 19, 2019 - 8:26 AM - 8:26 AM

If they’re back on the streets, street justice could take over before this makes its way to a courtroom.

Yep, they were probably better off, all things considered, in jail.

Sounds like nobody attending the “party” wants to get involved for fear of reprisal from one gang or the other. The perps will scatter, and may never do time ultimately.
The only good news is that no innocents were harmed, and that Air BNB has been put on the hot seat.

slagheap November 19, 2019 - 12:41 PM - 12:41 PM

BOTTOM LINE: At this juncture the DA doesn’t feel he’s got enough to proceed with a reasonable chance of conviction. They’ll keep digging. Meanwhile lot of bozos here love running their mouths.

crusader November 19, 2019 - 9:12 PM - 9:12 PM

i said it before and i’ll say it again… the bay area has gone down hill and is overrun by liberal politicians. the working man is second class to criminals and society’s mooches. meanwhile the working class is stuck paying the bills. insurance companies love it cause all victims get stuck paying higher premiums etc. let’s not even get started about how these trashy pos’s spoil the fun for everyone. just turn on the news people, an overwhelming majority of crimes committed are by ______ people.

Fred P. November 20, 2019 - 7:40 AM - 7:40 AM

And you can thank the liberal/democrat voters in the bay area who are unable to think for themselves and (as a politician put it) would vote for a glass of water if it had a “D” on it.

Obviously, the liberals love trashy POs’s, society mooches and criminals.

Rob November 20, 2019 - 9:04 AM - 9:04 AM

Uh – did law enforcement seriously over-reach here and they don’t really have any clue about who the bad guys actually are?

Or, is the DA just needing to firm up the case before proceeding…

I guess we’ll know soon.
