Governor Signs Bill To Reclassify Some Workers As Employees

Gov. Gavin Newsom on Wednesday signed Assembly Bill 5 into law to reclassify workers for ride-hailing services and other companies as employees instead of independent contractors starting in 2020.

Newsom issued a signing message for AB 5, calling it “landmark legislation for workers and our economy.”

He said classifying workers in many sectors as independent contractors rather than employees “erodes basic worker protections like the minimum wage, paid sick days and health insurance benefits.”

Officials with the ride-hailing companies Uber and Lyft have said they plan to back a ballot initiative next year to ask voters to create a new employment category for their drivers.

After the state Legislature passed the bill last week to send it to the governor’s desk, Uber chief legal officer Tony West said the company was disappointed it couldn’t reach a compromise with lawmakers and said a
majority of their drivers prefer to stay as independent contractors.

AB 5 sought to codify a state Supreme Court decision last year that said in order for workers to be considered independent, they must be free from the direction and control of the hiring entity, perform work that
is outside the usual course of the entity’s business, and be customarily engaged in an independent business.

Newsom in his signing message said the next step he plans to take on the issue is “creating pathways for more workers to form a union, collectively bargain to earn more, and have a stronger voice at work — all while preserving flexibility and innovation.”

Newsom is a dangerous idiot. Never worked a day in his princely life. Something seriously wrong with the voting public.

wow what did he say
Newsom in his signing message said the next step he plans to take on the issue is “creating pathways for more workers to form a union, collectively bargain to earn more, and have a stronger voice at work — all while preserving flexibility and innovation.”

so he wants public services to strike and hold patrons at strike point when ever the union desires ….. what wow

we now know who is backing the newscum in sacramento

all while preserving flexibility and innovation.” just what does that mean newscum….

does it mean that you are going to make it legal and non regulated for illegals to sell fruit and wares on anyone street and or corner tax free ….

or create a self absorbed tax for politicians to fund their children and vehicles ….for only 2% increase to bread and donuts

Politicians running this state appear to have two masters, the mega rich and unions.

Another free handout to people who work when they want and how often they want. You’re a Uber driver who chooses to work when you want independently! Why should you be given all the benefits of a regular 9-5 employee who has to be at work on a daily basis? Uber and Lyft is a side gig not a full time job.

The continuation of paddling towards the far-left, the sooner the State turns red. This move helps the transition, as does the west coast bum explosion. Perhaps within a decade we’ll have a Republican Governor?

One word, MORON!!!

Be careful what you ask for. You then will live with the consequences.
The governor has stepped over a red line. Another nail in the California coffin. Do you hear that sucking sound? Rest of my family have left the state.

Ten posters ahead of mine and I agree with every single one. It seems that the only smart people in the entire Bay Area are in Contra Costa County.

Sign the Impeach Newsom petition and join the impeachment march rally October 5th at the state capital.
Don’t just gripe about him, DO SOMETHING! Get active! Get this demon outta here!

How about the whiners take the important step of voting? Many do not, but just complain instead. Claycord should require its political commenters to state whether or not they do vote.
I vote.

I do not know how easy it is to register yourself as a LLC (Limited Liability Corporation), but I do know in Louisiana it’s minor paperwork and a small fee. If Uber drivers were to register as LLC, I would think this would work as work around. Again, I’m not that familiar with CA Law, but I was a LLC Consultant and I found it to be lucrative.

If Uber and Lyft want them to be Independent Contractors then they need to be treating them as such.

But Uber and Lyft want it both ways – they want the control that being employees would give them but then they want the freedom that having Independent Contractors provide.

Either way – honestly – given the Burn Rate of these companies they will be out of business as soon as they can’t find any more suckers to shovel money at those companies – that have never even come close to making money.

Their only real option for survival of these companies is fully autonomous cars so they can get rid of human drivers and the costs associated with them completely.

Tired September 20, 2019 - 8:31 AM - 8:31 AM

Newsom – this will make Uber & Lyft more expensive, reduce the quality of the ride, and reduce pay to most of the drivers.

Most drivers will be negatively impacted by this. You gave a leg up to a small section of the existing drivers at the expense of the drivers, and the public

Congratulations. You are terrible

RANDOM TASK September 20, 2019 - 8:39 AM - 8:39 AM

again though lets not forget

these drivers want to do this and signed up to do this
this way …what right does newscum have in forcing them to unionize and give newscum his kickback

also claiming they are being disenfranchised ….and need benefits

again they signed up to do this

stop the campaign for trying to make every job have to be a lifelong retirement based job ….it does not work that way or everyone would be delivering papers all day or packages ….lol

keep the dirty political hands off of enterprise and personal gains and choice

Then every one of the should be required to work a set schedule instead of whenever they want. The whole business plan for these companies was to allow “independent contractors” to sign on and off whenever they wanted to. They were their own bosses. If they’re demanding all the benefits of a “regular job”, they should have to work a regular job!

Old-school guy September 20, 2019 - 10:28 AM - 10:28 AM

I can just hear the conversation;
Uber: your new work schedule is midnight to 3:00AM, to pick up the drunks
Driver: no way
Uber: you’re fired.

PogueMehone September 20, 2019 - 10:31 AM - 10:31 AM

Yes, but… In yet another anti-business move by the state of California, there are costs to having an LLC and they are fairly substantial. To initially file costs $70 and then another $20 for a Statement of Information within 90 days of filing. But, most substantially, nearly all LLCs pay an $800 annual “franchise fee” to the state. How many Uber trips is that for a driver? I’d guess quite a few. Also, there are tax consequences that make preparing your taxes more complicated when you are self-employed. Folks that are doing a good thing by trying to earn a few extra bucks on the side, and carrying their own weight instead of just getting handouts, may not be prepared to deal with the consequences of incorporating themselves/using an LLC.

American Citizen September 22, 2019 - 2:36 PM - 2:36 PM

The Lemmings voting for him overwhelmingly. This is what the people want here in Communist California. I can guarantee you he will serve a second time. Then when he tries to run for president, he will be soundly defeated by most of the sane residents of the rest of the country..
