Contra Costa District Attorney Announces Updated Immigration Policy

May 15, 2019 10:00 am · 29 comments

Contra Costa County District Attorney Diana Becton announced her office has updated its immigration policy.

“It is important to have a standardized process in place to ensure we meet our obligations under the law. I am confident that with this new policy we can fairly review all options for a disposition while at the same time ensuring we meet the demands to protect the public and victims,” said DA Becton. “Moving forward, cases will be evaluated by our state legislative mandate to ‘consider the avoidance of adverse immigration consequences in the plea negotiation process as one factor in an effort to reach a just resolution.’”

Last July, for the first time ever, the entire Office received an in-depth immigration training which focused on the role of prosecutors in considering adverse immigration consequences.

Cool, I will call my lawyer and find out what that means.

Double Dzzz May 15, 2019 at 12:47 PM

Funny Ricardoh, exactly.

didn’t her oath include upholding Federal Law as well?

RANDOM TASK May 15, 2019 at 10:47 AM

so it appears if your illegal you can commit a crime
not be sent packing
not be convicted but get a lesser charge and community service
as we all saw a multiple illegal deportee offender killed a us citizen and is free and still in the country telling tales of the stupid demifornia laws that allow illegals to kill US citizens and be protected
this seems to pave the way for illegals to take over the state by force and we by dem laws can do nothing about it
so where do I denounce citizenship and get protection because the law just set a target on US citizens
or maybe just anti socialist communist demifornia citizens are the targets
its beginning to seem a lot like 1940 germany ….

Yes, Immigrants will get away with everything and take this country by force, yes so true you’re so smart. Immigrants are the root of all problem yes just like WWII let’s target a specific group of people and put the blame on them for all of our problems yes.
Stop acting like you matter to the government and they care about your rights. You don’t mean anything to them unless you’re in the 1%,

Hang on folks. This DA is going to lead us down the slide towards anarchy. She also is implementing a restorative justice program for juveniles. Means a teen burglarizes your home he isn’t locked up , but he does have to apologize to you.

Our current plagiarizing DA is more worried about an illegal having to go home then protecting us, which means she will plea bargain away deportable offenses.

The good news is some police unions , and Chiefs, are in discussion about getting a real DA next election.

Sign from Above May 15, 2019 at 11:06 AM

Paul Graves would have been a “Real” DA…….Just saying! But he just wasn’t liberal enough for California. He wanted to fight crime and put criminals away…..

No Excuses May 15, 2019 at 11:08 AM

So, the very need for “this new policy” seems to indicate that prior to this “new policy” the DAs office has NOT been “meeting their obligations to follow the law” and/or NOT meeting “the demands to protect the public and victims.”

So, now in an effort to further NOT meet obligations to citizens, prosecutors will take into consideration the fact that the criminal compounded his crime by evading being caught and should be treated as less of a criminal because he was afraid his illegal immigration status would not go in his favor…but…if a citizen were to commit the very-exact-same-crime…wham! Full hammer down! Right?
OK. We already knew we were being forced into a criminal sanctuary status – by our poorly chosen officials, and were already having our [expletive deleted] “privilege” of citizenship stripped from our grasp. So, it’s official. Thank you very much.

MikeyV May 15, 2019 at 11:19 AM

Serious BS. Where’s the part about prosecuting them for the crime of being here illegally.

Why in world should being an illegal alien get you benefits in a criminal case?

I’m waiting or someone to come on here and say they voted for this buffoon.

Graves was the best choice. Fools!

“Hey, wanna repeal Brown’s gas tax that no one voted on?
Sure let’s vote!
We voted to keep the tax.
Whaaaa, my gas is too expensive.”

How dumb can you be?

mtzman May 15, 2019 at 11:30 AM

I voted for her. And speaking of how dumb can you be, please note that the DA prosecutes state crimes. Illegal immigration is a federal issue and that wouldn’t be any different under Paul Graves.

MikeyV May 15, 2019 at 11:43 AM

I’d LOVE to hear the reason she got your vote over Graves?

mtzman May 15, 2019 at 1:13 PM

Here’s what I posted on claycord right after the election:

“Paul Graves may very well be an excellent prosecutor/trial lawyer but I simply didn’t trust him not to be a part of the good ol’ boy network that needs to change. The continuous attacks on Becton having never tried a criminal case ignored her 22 years of service as a judge and also misled voters into thinking that the elected head of a large DA’s office would actually try criminal cases on a regular basis, which, of course, is nonsense. There is a lot more to the job and Becton was clearly better qualified to represent all of the people of Contra Costa County.

Finally, the continued references to George Soros and being soft on crime was also misleading, especially in light of the fact that some of Graves’ supporters didn’t seem to have much problem in the Walton family support of Ron Leone.”

MikeyV May 15, 2019 at 1:59 PM

You lost me at “Good Ole Boys Network”.

Pure drivel.

AJ BUTTACAVOLI May 15, 2019 at 11:23 AM

I am in a real pickle over this issue. On one side I support the wall because something has to be done to rectify the mess that exists, but on the other hand I grew up in a Latino culture so I support those who wish to come here. The Latino culture is wonderful and very Catholic and since I am Catholic I think the more the merrier. Latinos are hard working, honest and very nice. Because I am Catholic I feel a real empathy with Latinos because of their support of the Church. The Latino influence in America is a good thing all the way around. It softens the hard edge of America, the macho we’re the biggest and the best attitude which is not only arrogant but condescending. Sadly the “ugly American” is a reality that is not only true but seems to be getting worse because of our big guns. Trump may have gone too far in supporting the idea of a “great” America but after that wuss Obama who bowed to the Emperor of Japan, among others, anything would be an improvement. People rant and rave about Trump but they got what they deserve after electing Obama.

Rollo Tomasi May 15, 2019 at 12:10 PM

I agree with you. Immigration enriches our own experiences. The left just continues to fail or refuse to discern the difference between immigration and illegal immigration. Not surprising. They have the same difficulty with auto and semi-auto.

Michael May 15, 2019 at 11:50 AM

Currently, if a person has a green card and commits a felony or domestic violence, immigration has the right to revoke their green card. How many times will a victim of domestic violence have to endure abuse from their partner or family before the prosecutor finally decides to use deportation as a consequence to their crime? This is going to go very bad for all domestic abuse survivors.

Time to Move May 15, 2019 at 5:29 PM

You may remember that the Oakland mayor justified her warning to the community that an ICE raid was coming by saying that she believes the community is better off when they’re with their families rather than deported. About a week later, a guy who escaped the raid was arrested for beating up his wife.

This mentality of protecting criminals here illegally is pure insanity. I don’t know anyone who endorses this idea, so I can’t figure out why the politicians do and why people voted them into office.

Chicken Little May 15, 2019 at 12:03 PM

“Latinos are hard working, honest and very nice.”

That’s a load. Just like any other culture, some are good hard-working people and some are not. There’s nothing about being Latino that makes somebody a good or bad person.

I’m all for letting in people from all over the world, as long as doing so provides some net benefit to the United States. But they need to be vetted, and that can’t happen when they’re sneaking over the border by the thousands.

Build the wall.

Bay Area Native May 15, 2019 at 12:03 PM

It seems as if this policy is intended to avoid the deportation of “noncitizens” who would be criminally convicted of a crime whenever possible.

“Adverse immigration consequences” are to be raised during the plea bargain process because deportation “may be by far the most serious penalty flowing from [a] conviction … ”

Do I understand it correctly?

Hmmm ..

There is a simple fix: Build The Wall to stem the ongoing, massive influx of “noncitizens” who would potentially commit crimes.

A more complex fix: let New California (or the State of Jefferson) become the 51st state as a “sanctuary” for conservatives and libertarians…

Sick of it May 15, 2019 at 12:20 PM

Right at this point she should be removed from office for not informing the law as written. It is a federal offense to come in here illegally. They use stolen SS numbers to work here basically identity theft. Why are these idiots protecting them? Can anyone give one good reason why. We the people of California need to remove all of these people that do not enforce the laws and have supported the illegals over us. And that boils down to pretty much the whole Democratic Party who is selling us out to a foreign power. Me and my family live by the law they should to.

The Professor May 15, 2019 at 12:39 PM

I’ll give you one good reason: VOTES!

Allow them in. Give them free stuff. Don’t prosecute or deport.

It all equals a Democrat for life (and the lives of their children, grandchildren, great grandchildren, etc.) The Dems have no platform beyond buying votes.

Anonymous May 15, 2019 at 12:24 PM

I have an idea to save money. Combine the DA and Public Defenders Office. They both have the same goals of keeping crooks happy.

The Mamba May 15, 2019 at 12:25 PM

Ah, so people here illegally may not be charged with a crime if it could hurt their immigration status? What a steaming pile of BS. Illegal immigrants and the homeless have more rights than us.

Ricardoh May 15, 2019 at 1:04 PM

Does anyone watch the nighty news from the Bay Area? We cannot just let anyone into the country. The idea is to allow the good in, not the bad with the good. Not all poor and unskilled. Not the perverts, thieves, and drug dealers but good honest people. We have enough bad of our own.

mtzman May 15, 2019 at 1:44 PM

So before we head down the road to total anarchy or a total overthrow of our state, did any of you legal eagles bother to actually read the policy? If you want to see a steaming pile of BS, just read the comments.

Frank May 15, 2019 at 2:21 PM

In essence it says they will aid and abet criminals in avoiding the consequences of their behavior.

Did I Say That Out Loud May 15, 2019 at 3:57 PM

Layman translation: “We are a sanctuary State and we aren’t going to do anything to make it look like we aren’t.”

RANDOM TASK May 15, 2019 at 5:06 PM

ok first
jumping a fence and buying illegal ss# is illegal AND NOT IMMIGRATING
WE HAVE LEGAL WAYS TO ENTER AND BECOME A RECOGNIZED AND PROSPEROUS CITIZEN.….

NEXT
while I appreciate your honest approach to approving of illegals
and the softening of America by flooding it with illegals
and your quote … I simply didn’t trust him not to be a part of the good ol’ boy network that needs to change.

YOU DO KNOW THAT THIS STATE IS A SINGLE PARTY GOOD OL GIRLS NETWORK THAT NEEDS TO CHANGE …

you and obviously many others touting yay for illegals and anything illegal and making laws so crimes are legal is not what this country is about

…maybe in other countries it is ok to fudge laws and do what you want and just bribe police and ignore the fact of laws

To describe America as needing to be taken away from its arrogance ???

you do know when people come here legally they are required to learn the history of our country and what it stands for ….right
that is why we are who we are …we stand for freedom and prosperity
for all who enter legally …again legally
democrats have convinced people that coming here illegally is called immigration …it is not …that is why we have legal immigration

That this country was formed to be free from gov control over the people and over taxation for corrupt means …
that this country went through a civil war to free the oppressed
that this country helps defend countries that would be taken over by other and met with deplorable conditions
that this country believes you can be who you want and will be helped to do so
WE ARE NOT LIKE ANY OTHER COUNTRY FOR A REASON …WE ARE FREE
you don’t see people jumping in boats and heading to china or Russia do you ???
stop using a democrat agenda approved lingo to further the oppression of this state
just say what you want to …..illegals are being allowed in because of the party power vacuum that is uncontrolled and doing what ever it wants

the fact that people actually voted to make theft legal is beyond me
a lot of countries chop off your hand

by the democrats of this state making laws to not only allow illegals ..but now to basically let them commit any crime and not only not be deported but plea out to a lesser offense with no jail time …..while as some one else pointed out a legal US citizen would be in jail with no pleas
is beyond comprehension and that it is being allowed shows
that this state is being run by people with the explicit intent to flood it with illegals and overwhelm the system
WHY …does anyone have any idea why illegals are being given amnesty to do as they please and US citizens are being ostracized
best part people are falling for it ….seems like 1940 germany all over again

Time to Move May 15, 2019 at 5:23 PM

Prosecutors need to consider “adverse immigration outcomes”???? So if a guy commits a felony that’ll get him deported, I guess it’s now official policy that our D.A. will drop it down to a misdemeanor so he won’t get deported. Oh, great. How does this serve the people? It sounds to me like it’s serving criminal illegal aliens at the expense of their past and future victims. This is disgusting.
