Mark DeSaulnier issued a statement today on the appointment of Matthew Whitaker to Oversee the Mueller Probe.

The following is from Mark DeSaulnier:

“Donald Trump bypassed the Senate’s advice and consent role by appointing Matthew Whitaker to oversee the Mueller probe without Senate approval. In doing so, the President is attempting to erode the checks and balances laid out in our Constitution. I, along with my Democratic colleagues, am prepared and ready to fight this troubling move. It is time to protect the rule of law, Constitution, and our country from this illegal and unconstitutional act by the President of the United States. In the interim, Matthew Whitaker must recuse himself from the Mueller investigation and adhere to any recommendations made by the independent Office of Government Ethics.”

I did. Then I read 5 U.S.C. 3345. I dont know if Whitaker’s rate of pay was at least that of a GS-15 level employee, but if it was I can’t see where his appointment as acting AG is illegal, and I can’t find a SCOTUS decision anywhere regarding that code section.

JohnS above is an exception by citing evidence and law. I disagree with the conclusion, but recognize it is comments like his that make for a productive discussion. In contrast, the prevalence of ad hominem attacks (“idiot” “douche” etc.) doesn’t deserve a response.

Actually the real FACT is he wasn’t appointed to take over the Mueller investigation. He was put in as the TEMPORARY ACTING AG,until a new one is appointed. As Acting AG, yes he is in charge of the department and all it covers. But to falsely call it he was appointed to take over the Mueller investigation is just, now how do the dems call it…oh yes, ALT-FACTS!!!

The Vacancies Reform Act does not overrule the US Constitution. It is an open question whether or not using the VRA in this manner violates the explicit provisions of the Constitution.

Mueller would need to release to a grand jury and the GOP Congress would block it anyway as they have done for trump’s existing conflict of interest illegal activities. This is also how bill Clinton survived. We know trump people met with the russians; Jared Cushner was there. Russian intelligence was celebrating the trump win.

I never hear any criticism of him from his supporters.

Even if he torpedo’s the Mueller investigation he is going to have to deal with the House and I’ll be here laughing at how the Trump family will get indicted one after another and all he can do is turn red and tweet away about how unfair it all is that he got caught.
