Contra Costa Sheriff Set To Close ICE Detention Facility In Richmond

Contra Costa County Sheriff David Livingston announced plans today to end a contract with U.S. Immigration and Customs Enforcement and the U.S. Marshals Service that allowed ICE to house detainees at the West County Detention Facility in Richmond.

The undocumented migrants affected by this move could be relocated to other facilities as far away as Colorado or Hawaii, Livingston said, based on past precedent set when other counties have taken similar actions.

There were a number of factors driving the decision, according to Livingston, but money was definitely one of them. The contract generates roughly $2.5 to $3 million in revenue, but costs have risen in recent years
and the rate paid by the federal government to house ICE detainees has not.

“Long term, the contract is just not sustainable,” Livingston said at a news conference in Martinez.

The frequent protests outside the jail were also a factor.

“Managing protests in Richmond have become expensive and time consuming for our staff. And to be fair, to be very fair,” Livingston said, “one must acknowledge a growing chorus of community groups and individuals from both within and outside the county who have focused on undocumented immigrants issues.”

“They raise important concerns,” Livingston said.

“I think you’d have to be living in a cave not to understand that there’s a growing discontent here in the community,” he added later while responding to questions from reporters.

Supervisor John Gioia, who has spent the last year calling for this contract’s end, called this a “historic day” for Contra Costa County.

But Supervisor Karen Mitchoff said, “I am here to share a different perspective. I am sorry we’re losing this contract.”

The loss of the $2.5 to $3 million in revenue was one of the barriers faced in getting to this point.

The loss, Livingston said, would have likely required him to layoff sheriff’s deputies, but state money was found to backfill some of the hole and the difference will be met with reserve funds.

Livingston said he was unable to lay off deputies.

Mitchoff said, “It is the Contra Costa County taxpayer who will have to fill that hole.”

She also acknowledged that the local families of detainees currently held at the West County Detention Facility may be adversely affected by the cancellation of this contract, in that seeing their loved ones will require them to travel out of the area.

“Those same undocumented families that we care about will no longer have easy access to their family members during this trying time,” Mitchoff said.

Rev. Deborah Lee, with the Interfaith Movement for Human Integrity, issued a statement this afternoon calling on ICE and Livingston to orchestrate a “just and responsible closure” rather than simply transferring detainees away from their families.

“Closing this facility is not yet a victory,” Lee said. “It will not be a real victory unless current ICE detainees are released and reunited with their families.

“Our ultimate victory is an end to immigration detention, not merely the closure of one facility,” Lee said, calling on other sheriffs around the state to “fully disentangle and separate themselves” from the deportation system.

In a statement echoing Lee’s concerns, the Contra Costa Immigrant Rights Alliance said, “While ending the ICE contract is a step in the right direction, we are concerned that the Board of Supervisors and the Sheriff’s Office made this decision without consulting community members and those who are directly impacted.

“ICE and county leadership must do more to ensure a just and responsible closure – not simply a transfer of people who are detained to other detention facilities, far from their loved ones with limited to no access to legal representation.”

Livingston said that he would be working with ICE to ensure an orderly wrap up of operations, and that federal officials would make an effort to resolve the cases of the affected detainees before the contract ends after 120 days.

Those that are there will be moved further Away from their loved ones while awaiting their case. I do not see why this is a good thing for Contra Costa county. Yawn, fear of immigrants has been around since the beginning of this country. The fact is, Immigrants cause less crime than American born citizens.

I’m all for fixing the immigration problem in this country, but make it fast and allow easy access to working visas with an eventual path to citizenship. Republicans are so quick to kick out the immigrants that they don’t see that much of our economy and food generation relies on these immigrants. Farmers are struggling so much to find workers that wages are increasing, yet Americans still don’t want the jobs. There are labor shortages in many industries where immigrants are the primary labor. Those are all facts and if we don’t fix the immigration problem you can expect to see food prices to skyrocket as well as the prices of goods and services (Although Trump is doing a great job at raising those).

But yeah, let’s go ahead and blame the immigrants for all the fake news problems that Conman Don keeps saying. Anyone that isn’t blind to the right wing swill can see that the Conman is just using the same techniques other Fascists and Dictators have done. Make a common enemy from those of little power for the majority to be angry at for all of the nation’s problems.

abp Real or imagined, longtime residents are entitled to be fearful of illegal immigrants who have felony convictions and have already been deported several times. They have already proven they are not responsible, trustworthy members of society. These are the ones ICE are detaining. Where can residents who are legal, law-abiding citizens get “asylum” from this invasion which is impacting their freedoms and financial well being and the ill-informed who protest the rule of law?

Close the facility, but return them to their families. Even if there is a case pending. There are a lot more criminals out on bail, at home, but families are being ripped apart by the Republicans and 45’s evil plans.

I’ll bet she doesn’t want just anyone coming and going at will through her house, helping themselves to her personal property, eating her food, driving her car, sleeping in her bed. Because it is her property, she wants to protect it from that sort of invasion by a stranger who does not have her interests in mind. Does she have a fence around her property? And why … to keep people out, to protect herself and her property, for liability reasons? Perhaps to protect her very own ” human integrity?”

Same difference with our country. If you want to come and visit, please do so and then go home. If you want to take up residence and immigrate, we’d like to know a little more about you and you will need to know about how we do things here, so please do it legally. There is a “human integrity” issue if ever I saw one! I guess the homeless would do better to cross over into Mexico and come back into the U.S. seeking “asylum,” since they’d be housed, clothed and regularly fed. Something that isn’t happening for them now. Their plight certainly isn’t being addressed as systematically nor as completely as that of illegals. When our own homeless problems are solved we can take on the world’s homeless problems, otherwise known as illegal immigration. Liberal hypocracy … it’s stunning!

IF it wasn’t obvious before, Democrats care more about illegals than they do about American citizens. If they did care there would be press releases and TV interviews about Black children being shot and dying each week in large cities across the country.

Sheriff Livingston is likely doing what he was told to do by those who run this state. Anyone surprised “STATE” money was found to make up for the loss in revenue of $2.5 to $3 million.

On the plus side for the Sheriff and Deputies , they won’t have to put up with any longer with the endless stream of politicians showing up with camera crews and reporters in tow for their free face time on TV.

Black Knight – I can tell you from experience it’ all about money/funding.
Feds made big requirements of the SO & HSD. Both depts. complied, bought required equipment, supplies, held trainings etc. It too both depts. 3 years to get the reimbursements. 3 YEARS Bottom line is the Feds are the worse bill payers when it comes to special programs where they make the requirements and mandates. Public Health spent millions on regfrigerators & anthrax vaccine and it took forever to reimbursed. So the county (as in taxpayers) had to carry the dept for years. The feds still owed PanFlu money to the county when I retired and we were almost 4 years out from that. The SO probably could not afford the contract because the Feds are deadbeat leaches.

I was responding to another posters comment about whether Sheriff Livingston had taken an oath of office, and not as to why the contract had been canceled.

Interesting to know that the federal government is as bad at paying its bills as many corporations are to their vendors. Vendors don’t want to lose the business, so many corporations feel free to wait until they absolutely have to pay vendors. They feel that they should leave their money in the bank to earn interest, as it’s better that they earn the interest since almost all vendors are willing to wait to be paid.

I said it doesn’t mean that Sheriff Livingston or any government employee that takes an oath to uphold the United States Constitution (and I’ll toss in the California State Constitution too), it doesn’t mean they’ve READ, UNDERSTAND, or BELIEVE IN the Constitution!!! Now, peace officers have had instruction as to how Supreme Court decisions apply to Constitutional rights and how they are supposed to handle those certain situations when those Constitutional rights apply. It still doesn’t mean that all Peace Officers and all other government employees that take the oath to uphold the Constitution have READ the Constitution, UNDERSTAND the Constitution, or BELIEVE IN the Constitution. When you add in the absolute mess that the California State Constitution is and think they’ve all READ, UNDERSTAND, and BELIEVE IN the California State Constitution, THEN YOU’RE FOOLING YOURSELF EVEN MORE!!!

It has absolutely nothing to do with “not agreeing with their decisions!” That’s what making legal arguments directly to Peace Officers, court filings, and going to court are for!!! It’s all about using your rights and using the correct legal jargon to succeed when dealing with Peace Officers. Why would I not like their decisions? I haven’t been cited for anything when I’ve been stopped or in any other situation in more than 20 years of adulthood.

I never claimed that any part of the Constitution states the Sheriff’s Department has to contract with anyone!!! I simply made a general statement!!!

So all these people who demanded the closure expect them all to just be released? Ha ha ha! I hope they get what they wanted sooner than later. And they move them all to out of state facilities. Or they get deported sooner than expected. I’m tired of paying for illegals and their anchor babies.

I know it must be hard to understand the concept of law and order or the concept of law-enforcement but there are some rudimentary civics classes at DVC I’m sure they can help you as I can see you need it

You were the one that was questioning whether Sheriff Livingston had even taken an “oath of office,” and you have a problem with my comment? If you want to believe that each and every government employee that’s taken an oath to uphold the United States Constitution means that they’ve READ, UNDERSTAND, and/or BELIEVE IN the U.S. Constitution then go ahead, but you’re kidding yourself!!!

I posted this as a response to Black Knight butt figured some might not go thru that thread so………..

I can tell you from experience it’s all about money/funding.
Feds made big requirements of the SO & HSD. Both depts. complied, bought required equipment, supplies, held trainings etc. It too both depts. 3 years to get the reimbursements. 3 YEARS Bottom line is the Feds are the worse bill payers when it comes to special programs where they make the requirements and mandates. Public Health spent millions on regfrigerators & anthrax vaccine and it took forever to reimbursed. So the county (as in taxpayers) had to carry the dept for years. The feds still owed PanFlu money to the county when I retired and we were almost 4 years out from that. The SO probably could not afford the contract because the Feds are deadbeat leaches.

In the 1980s, I was told by a graduate student admissions clerk at UC Berkeley that there was no way the university could verify the transcripts and references presented by foreign students for admission to the College of Engineering. Many showed up unable to speak English. How do you learn something as complex as structural engineering as a graduate student when you cannot read, write, or speak the language of the institution in which you are enrolled. We have seen the results of that in colapsed buildings, bridges, structures that have failed worldwide, and it has happened at an alarming rate. When a structure colapses, I say to myself, “There goes another UC foreign engineering graduate.”

Also n the 1980s, an immigrant from Iraq told me they weren’t being persecuted, hey just had to say so to get in and that everyone knew it.
You are dangerously naive if you believe Americans are not being thoroughly taken advantage of by illegal immigrants. If an institution of higher education cannot vet its small by comparison foreign student admissions to eliminate those who were, in fact, ineligible, how do you think the federal government can possibly vet the massive number of illegal immigrants crossing our borders daily who know ahead of time how to work the system’?

So reunite them with their families and take them back to there country of origin. They need to start learning they can not come over here illegally.
