UPDATE: Contra Costa County Office Of Education To Conduct Forensic Financial Audit Of Clayton Valley Charter High School After Sudden Departure Of Administrators

The Contra Costa County Office of Education plans to conduct a forensic financial audit of Clayton Valley Charter High School after the sudden departure of Executive Director David Linzey and at least one top level administrator, according to a statement issued by the Office of Education to Claycord.com.

“We are aware that there are significant issues at CVCHS in regards to the school’s top level leadership, and that the Executive Director and two other top level administrators are no longer in their positions. We have not, however, been informed of the nature of their departure,” said Contra Costa County Office of Education Chief Communications Officer Terry Koehne.

“Subsequently, we have sent formal notices to the Governing Board at CVCHS instructing them that we will be conducting a forensic financial audit of CVCHS and a full review of the school’s hiring practices. In addition, we have instructed them that they must preserve and retain all documents related to CVCHS finances and hiring practices,” Koehne said.

Hansen is the cure for what ails the County Office of Education.

The events of this week demonstrate how clueless Karen Sakata and her Deputy Superintendent Lynn Mackey are. The forensic audit is three years late and god knows how many millions of dollars short. This is what you get when complacency, cronyism, a sense of entitlement, and an unwillingness to tackle hard issues is the norm.

This forensic audit is way overdue and it can be laid right at the feet of the County leadership or lack of leadership. It is time for a change at the County Office of Education!

Leone needs to get out of the race right now. He’s so corrupted with all this it is hard to believe that anyone would even consider voting for him.

It was about time that school went under some kind of investigation. My son went to that school during his freshman year and he was discrimated and i was forced to pull him out of school due to a bunch of false allegation. Most of the staff there kept on leaving.

My daughter attended CVCHS all four years and graduated last year. She got a great education and has been better prepared for college than others. Now I don’t think it is good if it is found the Director and others violated the law but don’t trash the whole school.

Will there be a debate held for the County School Superintendent candidates? If so, I have Few questions for Ron Leone:

CVCHS denied a public records request to release your contract. Will you release it to the public?

What is your salary from CVCHS? What are your job responsibilities?
When were you hired? Are you still employed there? What was the hiring process?

You state you are the assistant superintendent for the CVCHS school district. But CVCHS is just one neighborhood school and does not have a superintendent. Please explain what superintendent you report to and assist. Please explain your understanding of CVCHS as a “district”.

When did the CVCHS governing board approve your hiring? (Hint: it never did.)

You signed the charter petition stating that you are a teacher meaningfully interested in teaching at the new Antioch charter schools. Do you intend to teach there?

The two teacher representatives on the CVCHS governing board also signed the petition stating that they were meaningfully interested in teaching at the new school, as did the Head football coach and almost the entire PE department. Do you believe they all intended to resign from CVCHS to go to the new Antioch school?

Do you consider a charter school petition to be fraudulent if the teachers who provide the required signatures as teacher “meaningfully interested” in teaching at the new charter school, in reality, have no intention of teaching there?

The Antioch school district staff found that the East Bay Tech Academies charter petition was deficient and did not meet state requirements for approval. You signed your name to the petition. Presumably, you believe it did meet requirements. Address each of the concerns found by Antioch staff.

Do you believe it is appropriate for a neighborhood school such as CVCHS to use money given to it by the state to educate its students and instead use that money to start a chain of charter schools in a different district? Shouldn’t that money be used for the education of CVCHS students?

It’s unbelievable when other parents put their heads in the sand because their kid is not affected by the crap going on at CV, As long as their kid is happy and getting a “good education”, then.everything is just fine. Well, the campus is bigger then one student, maybe you should ask how you kid’s friends are doing? Or what they think of the school? The school has poor wi-fi, which the students need to do online testing, there aren’t enough computers to go around for each of the students to use, and the classrooms are overcrowded. But hey, as long as your kid is getting a good education, let the corruption continue. Sadly, the good teachers are suffering/suffered too from Dave Linzey and the board’s antics, which is why most of them left CV!

Claycord, I want to offer a modification to your headline: the audit is a FINANCIAL audit, NOT a FORENSIC audit. The difference is significant: a forensic audit actually digs down to the receipt, paycheck, check and warrant level of a business. This is what’s SHOULD happen, as I requested of the Co Co Board of Ed over three years ago. However, what the Co Co Board of Ed is proposing is a desk audit of already audited financials. These audits do not look for discrepancies like a FORENSIC audit. I will be pushing Bill Clarke and the Co Co Board of Ed to modify their approach, so they can actually evaluate where the TAXPAYER monies have gone, and specifically how much the Linzeys have obtained over these past six years. Thank you.

No KJ, The charter was initiated by parents and teachers, who lost control of the process once they hired Linzey, who already had a terrible track record in LA doing the same thing he does best: steal tax dollars and reward supporters and family. When they were in the process of trying to get the charter approved, many promises were made about innovative programs that CVCHS students would benefit from, including, and I remember specifically, that every student would have an iPad. If I remember correctly, there were differences of opinion as to how the charter would proceed (once it was approved) which caused a rift with some teachers and staff, and then Linzey was hired – the rest is history.

I attended some of those meetings, years ago, when we asked for a forensic audit of Clayton’s books. Jeff Belle was outraged that such a recommendation was made – the mumblings, the eye rolling, the flapping of arms – in true Jeff Belle style, indicated that he was a major supporter of charters whether or not they were above board. Essentially nothing happened. And our tax dollars continued to be spent by the CVCHS Board without oversight, without accountability, and without transparency. This is long overdue folks. It is truly a shame that the complaints of students and parents of the school were ignored.

County Superintendent candidate Cheryl Hansen went to the County Board several times 3 years ago and asked for a forensic audit along with suggesting that the County could more than minimal oversight. She suggested that visiting the campus once or twice might be a start. She and others were met with crickets..
The County had contracted for a study of all the complaints from the public and got a 42 page document in return outlining many of the problems such as the blatant conflicts of interest i.e. Linzey hiring his wife, board member spouses having “jobs” on site, etc. The Board suggested they keep “an eye” on it and have someone report back. Guess what? Never happened. Superintendent Sakata never spoke to the issue, just as she didn’t on Wednesday night, never visited the campus, and never reported out on anything concerning the charter Her dereliction of duty caused a lot of problems and now she wants to replace herself with her clone, Lynn Mackey. who learned everything she knows from Karen Sakata.
Now the County is acting as if the forensic audit was their idea all along to cover their butts for ignoring their duty to the public for oversight.
It’s pathetic but when you have the County leadership unwilling to do anything, make changes, or see the need for changes you get what you have now.

There is now a Chalio Medrano listed as the head of Discipline and Attendance at the charter. He doesn’t appear on the California teacher’s credentialing site as having any credentials. Is he any relation to the infamous Joe Medrano who was the housemate of former(?) Dean of Innovation and Designated Sycophant? The County and the State should start looking at credentials of these people.

The entire board needs to resign, and all the apologists like Allison Bacigalupo need to be terminated. This group is a disgrace.

I have been wondering – People are saying this school has “millions of dollars in reserve” and “there’s $14 million in reserve” (both comments about the reserve fund are here)

I checked http://claytonvalley.org and the word “reserve” appears a few times but none of them support $14 million. Where did this number come from?

Here are the six mentions of the word “reserve” on the http://claytonvalley.org that seemed to be relevant to the reserve fund.

[1] INTERIM FINANCIAL REPORT for Fiscal Year 2013/14. Ending Fund Balance on June 30, 2014 is $5,307,886.44.

[2] INTERIM FINANCIAL REPORT for Fiscal Year 2014/15. Ending Reserve Fund Balance on June 30, 2015 is $8,702,292.04.

[3] “CVCHS will utilize the reserve fund in its budget to undertake any expenses associated with the closure procedures identified above.” It seems the school started out with a reserve fund from when it was a MDUSD school. Other than that sentence this rather long document does not mention the reserve fund.

[4] This page has been deleted ???. Go to the Budget & Finance page, click on Financial Year 2017-2018, and then click on the CVCHS 17-18 Second Interim Budget. The last line is ‘Unassigned/Unappropriated Reserve for Economic Uncertainties. The Unassigned/Unappropriated Amount is $14,861,874.73.

BTW – it is interesting to look at all of the expenses. Almost $550,000 for Travel & Conferences? $2.7M on Professional/Consulting services? For one school?

The difference is that at Cv she held and misused a position of power and instead of helping teachers, she silenced and was an instrumental tool for Dave Linzey to use to shit teachers out of the charter THEY established. See, the problem with people like Megan Kommer and Alison Bacigalupo is that they think they are professional educators because they’ve done some volunteer work for the PTA and that is somehow equivalent to an education degree or teaching credential. Wrong. Those women have no idea what they are doing up there. They have never truly studied educational policy, theory, code, or pedagogy. They are used to running their households and businesses and think that they can run a school too. They had no head for politics or policy, and assumed they knew better than the trained faculty. Then they screwed everything g up. Alison Bacigalupo and Diane Bailey don’t even have college degrees but they are in charge of a major part of operating a school. Hey, I’ve been to the doctor lots of times, can you put me in charge of running a hospital?

Please don’t act like being a volunteer on the PTA is equivalent to being on a school board. Megan, Alison, Diane, April, Ted, and the other Linzey mommy groupies knew they were in over their heads and they let Dave do whatever he wanted and were too spineless or stupid to stand up to him. If that school had a competent and intelligent board, it wouldn’t be imploding now. The people I have mentioned previously can’t even walk among our community now as they have backed this crook because he promised them big positions with big money to stay on the board and vote the way he told them so he could open more charters with CV money. It will all come out soon. What one person did at Diablo View is nice but this is totally different. These people not only ruined a school they have changed people’s careers and divided a great community. I have donated many hours and money to CVHS just like many others. Now the hard work begins to rebuild the school.

You do know there were many people who were literally blocked by the Board from volunteering, right? Many people who had impressive resumes were vetted out and deemed unqualified because they did not share the same “vision” that Dave had. The Board of Directors literally changed the by-laws thus preventing diverse opinions and ultimately hand picked and appointed people they wanted on the Board. You have no idea about the years I dedicated to CVHS and CVCHS. You don’t know anything at all, about any of this, and rather than criticize my “negativity” why don’t you recognize your own ignorance? How do you think I know what I know? I saw and experienced it for myself. If you don’t believe me, call up Megan herself right now and ask her to defend Dave Linzey. Go ahead I’ll wait.

I’m proud to say I’ve volunteered plenty. I’ve worked in classrooms, outside of classrooms, held positions on PFC Boards, campus clean ups, sports team mom, worked school auctions, headed up fundraisers, you name it…I’ve probably helped. You can relax, I’ve donated plenty of time and plenty of money to my kids schools. As a matter of fact, if you’ve done the same, then we probably know each other!

So now that I’ve answered your question about how I’ve helped can you acknowledge that the Board changed their by-laws to allow themselves the ability to vet out candidates they deemed unqualified because they didn’t share Dave’s “vision” thus eliminating a voting process and allowing themselves to hand pick board members? We ended up with a Board that chose to not oversee Dave for a substantial amount of time and look where it got us.
Do you think the board has any responsibility for our current situation?

This is a terrible situation. The people that secured this Charter then handed it over to a guy that already had problems down south. And the charter system with a few internal moves puts this guy in charge of millions of dollars as he puts layers of stupid people around him as hundreds of hard working administrators and teachers with credentials that were the fiber of the school were crying out and no one at any level district or county would listen. Our so called city leaders were supporting the bad along with other awful community people and parents as great teachers were resigning and finding other jobs. I hope they clean out the rest of the phonies that are still at the school acting like they didn’t know anything was going on. These people are terrible and shouldn’t be around children. This will set back CVHS years. Put the school back in the district. Thousands of kids got great educations there along with great memories. Time for the district and the county to get off there butts and step in. Fix this Disgrace now!!!

I’ve watched this thing unravel from the very beginning, and am well acquainted with all the parties involved. And I want to hear from all the crooked board members and toxic community members that blindly and stubbornly supported Dave Linzey and Ted Meriam, even taking their side over the achool’s teachers- many of which were beloved by students and very talented and experienced. So, Diane Bailey, Ms FISCAL MANAGER, can you really claim to know nothing of this financial mismanagement? You sure have a busy week ahead of you, getting all those records together. Alison Bacigalupo and Megan Kommer, the mommy-duo that think they know more about schools than the actual educators. You ripped apart your community and helped destroy a school for this guy. Are you proud? Sarah Lovick- wake up. You turned on your own friends, your blind faith in Dave is disturbing. You must be a miserable person. All of you have done something really terrible and you should be ashamed of yourselves, as this is all your fault.

The County Office of Education is on the warpath. They’ve sent a third letter to CVCHS ordering the governing board to provide a plan for replacing the three administrators who have left and the others that are expected to leave because they are going to the Antioch charters. They want the Plan by May 30.

The letter notes that the co-lead petitioner for the Antioch charter schools is a CVCHS administrator and all of the people who signed the charter petition except one are teachers or administrators at CVCHS. I love it! They are calling out CVCHS on the fraud they are committing on the Antioch school district.

The letter wants the plan to detail how they will replace all these administrators in a way that ensures transparency and stakeholder involvement, as their own charter requires.

The letter also wants the governing board to provide documentation that there wasn’t a Brown Act violation, noting the departure of the Executive Director and Chief Innovation officer the day after a special, closed door Governing Board meeting to discuss “employee discipline/dismissal/release”, but the Board said there was nothing to report from the closed session and has not held a meeting since then.

We (CCCOE) are not on the warpath. The internal discussion today was how to make this all go away and do it making the public think something was being done. We will probably do what we always have done – as little as possible with great paper shuffling, declarations of actions to be taken, and fervent prayers that people will forget. Ask one of us underlings how we do business and get the truth.

You know what’s funny? Dave Shuey was all over the last post in which Claycord reported that Dave Linzey was gone. He was all about “trust the board, let the board do its job”. Funny, not a peep out of him here, now that news of a forensic audit and basic accusation of fraud against CVCHS has come to light. Hey Shuey! What’s wrong? Did you suddenly realize that the board had actually been a huge part of the problem all along? Or is there another reason you’re keeping quiet? I sure remember you being a pretty active supporter of all things Linzey, and your city council did everything they could to give him a blank check. I hope you and the rest of the Linzey Lovers are losing LOTS of sleep. No rest for the wicked.

Hey has anyone heard a peep from April Winship? Wasn’t she one of the original board members who voted to hand absolute power to Linzey by firing Pat Middendorf? What about Neil McChesney? I hear he’s running a pretty low-quality school now that calls itself a performing arts school but they aren’t learning jack sh**. I wonder where he got the financial support to start that? Didn’t he write that charter while “working” as an “administrator” and “board secretary” aka Linzey’s pageboy? I dunno. Seems like there’s a lot of bad stuff going on with charters… maybe that’s because CHARTER SCHOOLS ARE A SCHEME.
