This is a post with no subject, you can talk about whatever you want. If breaking news happens (such a shooting, earthquake, etc.), or you hear about something newsworthy, feel free to post it here.

@apollo continuing discussion from last week. – The “fair use” part of copyright law allows us to copy of part of a work as long as a person is making commentary or similar use of the material they copied. For example, I agree with your statement “photcopy machine is there” but disagree with your belief about that “if someone desires to photocopy as much as they want” that it’s legal. In that example I copied two of your statements, both of which are copyright to you as you. However, as I used your words that in a “fair use” context my copying of your material is legal.

If I had copy/pasted your entire post and then only commented on the 14 words of it that I copied above then I would be guilty of a copyright violation.

We also are not allowed copy something simply so that we can use it later or to give or show it to someone else. For example, occasionally I’ve seen someone go into the public library, take several hundred movie DVDs off the shelf, and proceed to make copies of them using one or more laptops. Those copies are illegal. They would also be illegal had the person checked them out and made the copies at home.

Other than the fair use exception, you are not legally allowed to make copies of material using the photocopy machine in the library other than of material that’s in the public domain or where you own the copyright. We are also not legally allowed to use our cameras or phones to make copies of something either.

Here’s a bit of copyright law weirdness – did you know that buildings are copyrighted? Normally it would be illegal to take a photo of a building or a portion of a building. A specific exception had to be added to copyright law so that we can take photos of buildings as long as those parts we are photographing are visible to the public. FWIW, we are not allowed to take photos of statues or other artwork that may be on public display near or on those buildings.

You mentioned plagiarism or claiming that something a person copied is their own work. Oddly, plagiarism is not a crime and there are no laws against it. For example, I could publish a copy of the U.S. Constitution, which is in the public domain and thus free of any copyrights, and claim I wrote it. I’m free to sell copies of the WC Constitution. While I would be guilty of plagiarism there’s nothing others can do about it except to complain and down-rate me.

Years ago, I believe I read that one may copy otherwise copyrighted material for educational use. In other words, it may be copied if the material copied was intended for an educational purpose. For example, were a teacher to include a paragraph from a novel in a final examine asking the student to identify the author, the use would be considered educational and would be permitted.

As a piano instructor, I could not copy sheet music to give my students. But it IS legal to copy sheet music if your vision is compromised and you need to enlarge the print!
(A few years back, didn’t a local church choir director get prosecuted and fined for copying music for the choir members?)

Also, it is illegal to copy a stage play script to distribute to cast members. Even a community theater not financially backed by a city government must pay royalties to perform the play and must buy all scripts from the publisher. However, as a director, I could buy a script for myself and then make ONE copy of it to use as my “director’s book”…. script kept in a ring binder giving wider margins for sketches, blocking for the actors’ movements, lighting-cue points, etc..

These legalities differ between the disciplines, so why not just be safe by being honest?

Went to DMV with an appointment to get my Real ID, drivers license. Appt. at 1:45 PM. Get there and there is a 50 person line for those with appointments. The guard lets 2 people with appointments through the door and then 2 people without appointments. Took an hour standing in line to get through the door. Asked why did we need an appointment and he says rather surly, “Ask Sacramento”. Estimate 2 and a half hours with an appointment at Pittsburg DMV. Pay $28.00 to get a license that CA DMV screwed up and didn’t issue correctly in the first place. This state is a joke.

I recently went to Concord DMV and there was thirty people out the door. I said nuts to this and went to WC DMV. It wasn’t much better. It took me six hours to get out of there. Talked to lots of folks, this
was about average. I talked to a few people that had went to Oakland DMV at opening, waited all day, and were turned away. So they were trying their luck in Walnut Creek. I don’t know why this isn’t a huge news story, because I assume these conditions exist across the state.

People need to be aware. Don’t think you’re going to take a half day off from work to waste a few hours at the DMV like in the old days. It’s the DMV on steroids now.

The main reason given is that the transition to “Real ID” is fubar. For brevity I’ll skip the big picture analysis about how this all stems from 911 and the terrorists have won yet again. They don’t really “hate our freedoms”, but it turns out our own government sure does.

There is another change at the DMV which adds another layer of cruelty to this debacle, and which couldn’t have come at a better time. Gone are the old cueing numbers, tickets like “G87” or “B24”, where if your number was G87, you could see and listen on the screens if they were on G62, and you could get a sense of how things were progressing and anticipate how long your wait would be. Now they issue a personalized number of your initials and last four of your phone number, like “JW5387”. This means not only are you going to be there all day, but you have NO IDEA when your number might come up. You have to listen to each and every number all day. No humanitarian breaks. No running across the street to grab some food or drink, because surprise, your going to be there all day. And if you MISS your number, because after six hours you failed to listen to each and every number called out? You can always come back the next day, and this time pay attention.

I don’t generally advocate for privatization of government services, but the DMV needs to be shut down. Amazon or Netflix could do a better job in their spare time. Even if a private contractor did a really, REALLY horrible job, like just appalling, like making you wait 30 mins to get helped, that would be infinitely superior to the DMV. I have AAA, which is allowed by the DMV to handle just basic registration. I usually wait five to ten minutes and they have a free Keurig machine and comfy chairs. It’s like going to Starbucks. That’s it, give the DMV contract to Starbucks. Seriously, that would be better.

I encourage anyone who does not have AAA to make an appointment, it will save you a lot of time and stress.

Two books this time. A Ngiht to Remember by Walter Lord,1955. If it were a movie I would call it a docudrama. He works on piecing the Titanic almost minute by minute. He says he tried to piece together conversations as told to him or reported in newspapers. A dry read but not boring.

The Elusive Mrs. Pollifax1971, is one of several by Dorothy Gilman. My mom enjoyed spy stories and I found several of them. Having read this one I’ll have to find the rest of them that she had. Again, if this was a movie it would have to be a comedy. Mrs. Pollifax is a volunteer spy for the CIA that causes them heartburn while on the job but gets it done. If you want a fun read, this one or any of the Mrs. Pollifax books will do the job.

Did they ever find the suspects that shot the guy on Clayton Road apartments in February 12? I feel like there was not ever a follow up by PD. They were breaking into a car at 4888 Clayton Road and a man was shot and hospitalized. Is he ok? I am concerned because we just moved into the neighborhood by silverwood. Does anyone have info???

Not a fan of the new Facebook/MLB broadcast deal. I enjoy watching baseball in the summer. I follow three teams. Therefore, I pay to watch the games on MLB tv. I’m not on Facebook and I do not want to join Facebook. However, FB and MLB have now worked out an deal where certain games are broadcast ONLY on FB. The FB games are blacked out for MLB subscribers (who pay for the service) so that FB members can watch the game for free. This sucks – I’m prevented from using a service that I’m paying for because I’m not on Facebook? What kind of a strangle hold does that freakin company have on us? I’d be ok with it if the games were on FB and MLB also, but FB has a monopoly on this. Good thing our reliable Congress had those “hearings” with Zuckerberg. Our Congresspeople totally put FB on notice …… except they didn’t notice that FB is still controlling our lives.

My brother was complaining to me about the same thing. It’s a valid complaint. He pays for the MLB package (he watches all games) is a Giants fan, and couldn’t watch the Giants game the other day because it was only on Facebook, and he’s not on Facebook. Neither am I.

Baseball shouldn’t be on Facebook only. If they want to include Facebook as a viewing option – fine. But Facebook only is ridiculous. Especially annoying for those who are paying for an MLB package.

Thanks for your reply. I know exactly which Giants game you mean, because I tried to watch that one also…. but I was blacked out because of FB. I’ve googled several articles about it and MLB subscribers are very annoyed with this — and not only because of the money. Many fans commented that they’ve got a 50” tv with surround sound in their living rooms, but they’re expected to watch the game on a 15” laptop to keep FB happy. From what I’ve heard, FB’s broadcast also includes a Comments Thread rolling across the screen, along with a bunch of other crap, making the view of the game even smaller. But what can we do? If we cancel our MLB subscription, we don’t see the games at all. I hope more fans speak up about this.

Wow. That’s crazy. Major complaints need to be made to MLBtv by their customers. You PAY for a service yet get blacked out because you’re not on Facebook. Just plain wrong. Their probably trying to get more subscribers which will probably backfire.

Sad day for MLB baseball that they would do this. I’ve had some success in situations like that by writing to the President and/or CEO of the company and complaining. Don’t bother with any of the lower level peons — write the President/Ceo, whoever that might be at MLB … probably a Comissioner of some kind. Facebook and MLB sort of just cheated you out of something. You should not have to join what can only be considered the dumpster of the internet to watch an otherwise televised baseball game.

You can cast a show from your computer with a Chromecast or a Roku, but I can’t say for sure it would include MLB games broadcast over Facebook. However it is done, it is going to make it much more inconvenient to watch. None of them seem to consider the fans anymore.

The only time I’ll ever go to the DMV in person is less than 5 days before Christmas. I did that years ago, and 2-3 people were there. I was told it’s like this every year. Nobody goes to the DMV right before Christmas – other priorities.

Have been back to the DMV a few times in late December – less than 5 people every time. Early morning. No appointment. No wait.

Do any of you know what the sound of anti-lock brakes makes as a car is coming straight at you? Well, I do, it’s a pulsing of squeal and go and squeal and go. That’s the sound I heard this morning while crossing Oak Grove in the crosswalk with the light. The car was a black Mercedes sports car that did eventually stop well over the line. I must apologize for displaying my finger but well I was pretty angry. Is that what having the windows all blacked out is for, so you don’t have to notice the world around you? Sometimes it’s hard for me to remember that I should respect other people. Especially those who are so stupid that they will kill me.

Crossing directly in front of a black Mercedes sports car seems like a death wish sport. Did you have a brick in hand to fling through a window in case the car did not stop?

Considering tinted windows – I’d wondered if that car that had all of its windows broken out had tinted windows. I’m all for open season on every tinted window.

Have a tomato plant you wanted more of ?
Tomato plants have what are called suckers which can be clipped and made into individual plants.
Explanation of suckers, about the 2 minute mark.

Another way from what she does is to build a little cloning setup.
Used an ultrasonic mist generator and timer bought off eBay.
Drilled 1 1/2″ holes in lid of a plastic shoe type box.

Didn’t want to buy commercially sold hole seal / stem holders so bought a star shaped pool noodle at the dollar store. They’re foam with a hole running down the middle about 3 – 4 foot long, sliced about 1 1/2″ thick to get a donut looking piece then cut a pie shaped wedge out of them so it’ll hold the stem and seal into box top hole without crushing plant stem.
At a dollar a noodle, experiment until you find what works.

Tomato sucker goes into middle of the foam then it all gets put into hole in top of box. Mister provides high humidity which encourages roots.
We’re using a TU19 24-hr timer, goes for a bit over 7 bucks.
Half hour on hour and a half off. An keep the setup out of direct sunlight.

plus at work all I do now days is build industrial control systems.

We went with mail order hybrid tomatoes this year because last year’s retail plant offerings were disappointing and we wanted plants with greater disease resistance.

Thought others might want to try a low cost cloning setup which can be used for things other than tomatoes. Am a week into trying to get a Kiwi cutting to sent out roots. Already had success with rooting a Trumpet Vine.

I don’t have a green house but my bell pepper plant survived the winter & is already making baby bells.

I had a cherry tomato plant last 2 years as well… but sadly , it didn’t pull through for this spring.

I gave up my lifelong habit of growing my own tasty tomatoes in Claycord, the conditions in my yard make it too labor and chemical (fungicide) intensive for me.

Dr. Jellyfinger, in Oakland I grew the same hot chili plants for several years. There was a beautiful large habanero for 6 years on my back deck till we abandoned it, the pot was too large to carry in my car. I grow hot chilis here now in smaller fabric pots, these; that I can move around if I need to. I have 10 plants now setting peppers I’ve had for 2 prior seasons. They get covered through frosts and freezes with this stuff: , it’s great not to have to wait till Indian Summer for peppers.

Without doing any research, I am not immediately aware of any legal requirement in CA for an eatery to post prices.

I don’t go to Sweet Affair, but find it very odd for none of the foods to have prices posted inside the store. How are consumers supposed to know the validity of their bill? I’ve observed websites and menus taped to eatery windows without prices, but that would be more for a convenience of not having to update. In all cases, the actual menus/food items in the eateries had prices.

The only time I’ve noticed no prices listed at an eatery is when a daily special is noted as “Market Price” on the menu, and your server describes that day’s special and price to you. That usually happens with fish/seafood.

Saw a baby rattlesnake in my front yard just now. Sunning itself next to my driveway, then went into the bushes in front of my front porch when it realized I was there. I was just thinking about trimming those bushes tomorrow, but maybe not…… Anyone have any ideas on how I can get the snake to move on? I understand baby rattlers are quite dangerous. I walk my dog past these bushes twice a day. Don’t know where the snake is now. Thanks.

Are you sure it was a baby rattle snake? If you saw just a tail, may have been another reptile, including an alligator lizzard. They are breeding now and very active; their markings can mimic rattle snake markings.

We found 2 alligator lizzards mating recently in our front yard. Saw more on our backyard today. Don’t know, but good bet you have a resident alligator lizzard. And good to have.

If a rattle snake, can’t offer any suggestions unfortunately.

Well…. I can tell you how to catch a snake, but it might be more work than you’d like to do.

Buy a 5 gallon bucket with a removable lid.

Dig a hole deep enough to hold the bucket with the lip of the bucket just at ground level and toss a little bit of dirt in there, just enough to cover the bottom.
Go to the pet store and buy a couple “feeder” mice (they are real cheap) and toss them into the bucket (it’s too high for them to jump out).
Check the bucket once or twice a day and leave a little food for the mice every day too or one will eat the other.
You can leave a jar lid in there and pour a bit of water in it for them too. Now, unless a cat finds them first you are likely to find a fat snake or a possum in there one morning.
Just put the lid on it & pick it up by the handle.
Please make sure that you actually have a rattlesnake before you kill it & just let everything else go.

Oh, and be advised, a really big snake can get out of a 5 gallon bucket.

King snakes eat snakes & lizards that are smaller than they are but they also eat insects, mice, gophers, birds, etc. so if you think letting a king snake loose is going to protect you from rattlesnakes you’re wasting your money. Besides that, it will probably slither away & one of your scaredycat neighbors will kill it with a shovel.

Today is the second day of the Tour of California bicycle race. It involves a different course each day, ending in Sacramento on Saturday. Although bicycle racing can be like watching grass grow, the courses pass through often beautiful and interesting scenery which makes good TV viewing due to the mostly ariel coverage. In past years the race has passed through Walnut Creek, Clayton, Marsh Creek Rd, and year before last, the top of Mt. Diablo. The race continues today at 1:00 – 4:00 pm and is covered live on the NBC Sports Channel. There is also a 1 hr. synopsis later in the evening.

I have been getting slow speeds intermittently for a few months. They are blaming my computers. They say they’re too old for the newer wireless technology. The funny thing is it’s intermittent on both at the same time. They’ve been fine the past few weeks or so.

Deciding what you like to happen or accomplish then looking around for parts you might use to make it happen. This person must have watched all those re-runs.

Back in the ’40’s, in addition to erector sets there was a building set comprised of small rectangular wood bricks that fit together almost like Legos and you built houses, etc. with them. Also, remember Lincoln Logs?

My 4 year old is getting his first Lincoln Logs for his upcoming birthday. He’s old enough to play Lincoln Logs with us big kids now.

One of the great things about being a grandparent is being able to ask for toys and children’s books on my birthday, again. When my grandchildren come to visit, we shall have Lincoln Logs and Dr. Seuss to entertain ourselves.

My Berkeley Grandma had Lincoln logs. Never really liked em much. Besides building the log cabin and putting a fence up for the plastic cows it didn’t offer much. At home we had a “Girder and Panel” set that let us build a lot bigger things. Still mostly right angles though. It looks like that medium has just about run it’s course. is shutting down. I suppose ebay will have some for the next century or so. I am a fan of building sets, don’t get me wrong. My oldest brother when he was living up in Montana off the grid would pull out the big round barrel of Tinker Toys on a cold windy night and we had a great time with the wood stove keeping the house really toasty. I loved my Girder and Panel set. But then, I loved all of my building sets, including an Erector Set, Lincoln Logs, and some kind of plastic brick set that was much more realistic than Legos.

I just saw the latest Clayton Pioneer newspaper that shows an artist’s rendering of the proposed “Grand Oaks” assisted living facility and retail frontage…..
I am not pleased.
This new structure will not emulate the old town style of all the other buildings along Main Street, some of which were actually built in the 19th century.
No, I’m afraid the massive new building will be much like those in downtown Walnut Creek or Concord.
Does the city need the money so badly that we can’t just keep using it as an event area?
Dumb question…. $$$ rules…
Goodbye charming old town atmosphere…. nice while it lasted.
