The annual list of your favorite restaurants, businesses, etc. will be voted on this coming week, starting on Monday, so stay tuned!

We really do need a “Best of Claycord” all of these things people put in here–jumping to conclusions without facts or just wanting things to be true. Let;’s start with David Rosen–poor guy was in an accident, and everyone just wants to believe he did this purposely. wow. Then there’s the “whatever column”, the best yet. The entire thing should be in the top-running. People post nonsense–“just because”. Let’s get voting!

best troll of the year, i nominate Sunflush err fish. not to start that argument again but the only thing he did accidentally that day was get caught. with pending drug and weapon charges, the wannabe thug thief on purpose choose to speed (and or get high/text) and drive wrecklessly. had he not choose purposely to be the biggest doche bag on the planet, half a family would be alive.
How any one can still think it was an accident is beyond me.

Anon, I agree that it was his choice to speed; but it was not his intent to kill–which make the biggest difference. I usually don’t listen to what “friends” have to say-because they are the most likely to do you in (jealously, issues of their own, etc.)

ok funny man, I’ll bite. That all came into light after he was arrested–then the trolling and hate mail started. Yes, he did kill someone–but the question was “was it his intent?” We all feel the pain and suffering of this incident because it could have been any one of us–will the bashing help? doesn’t do any good to dwell on it. For me it’s Rosen who?

Friends are usually a reflection of the individual they cal friend. But hey put on those rose colored glasses and take the ped crosswalks. Won’t be my problem. You might consider his arrest previous to the event in question for drugs and gun, in his car. But maybe you’ll now use the friend card, to say, they weren’t his?

No Anon, I am not related to him. My point is, everyone has been young. Many of us have taken our parents to the point of exasperation. I have had many a joy ride with my friends, in the day–we have had near misses (which taught us); but no one was hurt. I think we were lucky.

It is unfortunate this boy had to go through these changes. He may have been experiencing his rebel side now–but he also may have matured to have actually accomplish something in his life. That part may be ruined for him. Continual bashing does no one any good. Let’s just hope and pray that he has learned something from this experience. So now, Rosen who?

The California penal code (PC) defines manslaughter as “the unlawful killing of a human being without malice.”

See PC 192(c) (1) – Vehicular–
(1) Except as provided in subdivision (a) of Section 191.5,
driving a vehicle in the commission of an unlawful act, not amounting
to felony, and with gross negligence; or driving a vehicle in the
commission of a lawful act which might produce death, in an unlawful
manner, and with gross negligence.

Negligent operation of a motor vehicle [driving dangerously]…

“Gross negligence,” as used in this section, shall not be
construed as prohibiting or precluding a charge of murder under
Section 188 upon facts exhibiting wantonness and a conscious
disregard for life to support a finding of implied malice, or upon
facts showing malice, consistent with the holding of the California
Supreme Court in People v. Watson, 30 Cal. 3d 290.

Bottom line – the killing of a person by another with the use of a car or other vehicle – no specific “intent” to “kill someone” is required.

The best karate school is Cutting Edge Martial Arts in Walnut Creek!!!

Walnut Creek Recreation has fantastic Martial Arts program called Cutting Edge Martial Arts that is taught by Sensei Preston Jones, a fifth degree black belt master. My daughter has been attending karate with Sensei Preston for several years and has gained self confidence, character development, and learned many martial arts techniques, but most of all she’s learning how to keep herself safe!! If you want your child to master safety this is the class to attend!!!!
