The family of the girl who claims she was raped by a door to door salesman today in Concord has told CLAYCORD.com they want everybody to remember the investigation is still continuing, and no final conclusion has been determined by the Concord Police Department.
Meanwhile, Lt. Garrett Voerge with the Concord Police Department says so far, the “initial investigation indicates that the suspect was passing out business flyers in the area when he contacted the 17 yr old female victim at her residence for the initial purpose of advertising. A conversation between the victim and suspect developed and ultimately led to sexual acts inside the victim’s home. Following this, the suspect left the residence and was found nearby and taken into custody without incident.”
Lt. Voerge says 20-year-old Santa Clara resident Ricardo Espino has been arrested for statutory rape.

First off, under the law, it can’t be consensual if the person is under 17, and he was arrested for having sex with a minor. The police are definitely still investigating.

Ok I get that charges will be pressed since she is under age, I understand that it’s illegal, my point is she is 17, she isn’t 12 or 13, she’s 17! So when I say consentual I mean exactly that! Does she not know the age of consent? I’m just trying to figure out why he is 100% responsible for this incredibly poor decision. They’re both at fault. And if she lied about him forcing himself on her then it’s entirely possible that she lied to him about her age. It seems some people think she shouldn’t be held responsible for knowing full well that what she was doing could have serious consequences for him (assuming he was not aware of her age and of course, she was, then it rather seems as though she’s entrapped him). If he is punished for statutory rape, she needs to be punished for false accusations. It also seems like she enticed him into the house, since he didn’t force his way in. Her parents should be just as ashamed of her as his of him. Funny, a month ago i was driving down YV Rd during commute hours (530 p.m.). There was a DRUNK driver ahead of me. i called 911 and told them the make and model of this car. I got ahead of the dude and he almost rear ended me. he ran red lights, he almost hit the center divider, he made illegal u-turns. I followed him and stayed on the phone wiht 911 for 15 minutes and NO cops showed up!!! EVER! they kept saying they were on the way. I’m pretty amazed how everyone on the previous story’s comments and this one are blaming this guy. Everyone is pretty quick to shift the blame from an “innocent 17 year old girl” to an “illegal mexican shifty door to door rapist” without knowing all the facts of this case. I’m quite sure she never gave any indication she was a minor nor did he ask. In any case this girl shouldn’t have been spreading her legs open for random strangers since we now know it’s not rape.
It’s pretty tough these days to pin a age on kids since they dress and act a bit more mature than they let on and coupled with the sexuality of youth you’re in for trouble if you run across one who is promiscuous as this guy just found out.
As someone who was involved with false rape charges back in college when an ex-gf got drunk at a party and had sex with a friend of a friend on a whim then filed rape charges against him after I found out about it the next day, I got to see first hand how easy it was to ruin someone’s life because she made a decision she would come to regret and tried to cover it up by calling it rape. Thankfully this guy had enough witnesses and he was able to avoid having his life ruined.
I am in no way condoning door to door gigolos, defending rape, or saying he’s totally innocent in this matter. But on face value and with what details we have in this case, I’d be willing to place most of the blame on the girl here. This guy is 22, he’s barely considered an adult and is probably still thinking with his penis like most guys do and didn’t stop and think of what the consequences would be if he took up a random girl’s offer for sex doing his rounds. For all we know this girl was trying to get back at her parents for something. Maybe she wanted attention.

The D.A. will not file charges on this. They know that no jury will convict this guy for statutory rape. Does it really matter physiologically or mentally if a girl is 18 or months or weeks shy of 18? They both made a poor decision and it sounds like the family is embarrassed and wants the boy to pay for it. (After all, a 22 year old is not much more mature than a 17 year old.) The D.A. will not touch this case unless mommy and daddy are personal friends of his.

The whole situation is scummy, but a far cry from rape as we generally think of it, or as they initially reported it. Because of their relative closness in age it is actually only a misdemeanor. Given the extenuating circumstamnces, or likely scenarios mentioned by other posters, I doubt this will go very far. Probably best, in the long run, for all parties involved and the tax payers.

Forget the morality issues here for a second. As the prosecutor so adeptly said in the Ben Rothlisberger case, “The job of the District Attorney is to prosecute criminal behavior, not morality”. Unless this guy’s birthday is more than three years after her birthday (something the cops could figure out in about 1 minute), he is not guilty of anything. The police should apologize to him before he sues the City for false arrest and labeling him as a rapist.
